I did have a conversation with the Doral Greens Property Manager, Frank Arcara,on Friday last at which time he inquired if the Building Department could gain forced entry to an occupied unit in the Doral Greens complex, no address was provided. My response was that the Building Department does not have the authority to force anyone to allow us to enter their property except in cases of unlawful construction or imminent danger. Unfortunately, a bug complaint does not rise to either level. That was the extent of my conversation with Mr. Arcara. I never told Mr. Arcara or anyone else that there is nothing that you as the property managers could do. For the Building Department to enter uninvited upon private property we must have substantial probable cause for unlawful activity related to construction or imminent danger or be summoned to a property by a higher public safety authority like the Police or Fire Department. We have a unit that is having a lien placed on it. That unit is causing the downstairs unit to have an insect infestation and we are not able to get in to the upstairs unit where the lien is being placed. A good and welfare check is happening for a while now with only a crack in the door open. Mike Izzy told our property manager that we are not able to do anything. This is a health issue for the lady below who is old and has a guardian taking care of whatever. Is there anything you would suggest we can do to get inside the unit?
