Relief is requested from: 19 NYCRR Part 1220, 2020 Residential Code of New York State, Section AJ601.3, Compliance, Exception 1, provided as follows: Space created in basements may have a ceiling that projects to within 6 feet, 8 inches of the finished floor; and beams, girders and ducts in such space or other obstructions may project to within 6 feet, 4 inches of the finished floor. [The petitioner requests relief for spaces in a basement with ceiling heights less than allowed.] FINDINGS OF FACT 1 The petition refers to the construction of habitable and non-habitable space in the basement of the subject building. 2 The basement ceiling height is compliant at about 6 feet 10 inches, however there are pipe, duct or beam enclosures as low as about 6 feet 0 inches. This headroom exceeds the average height of adult persons according to anthropometric data found in the current NFPA 101 life safety code. 3 The basement floor is of concrete construction and the first floor is constructed with conventional wood floor joists. In that the subject space is in a dwelling unit, used by individuals who are accustomed to their surroundings, the reductions to the height of the ceiling would not have a substantial negative effect on their health or life safety and are considered de minimus. 5. The plan shows an Emergency Escape and Rescue Opening, with minimum dimensions as set forth in Part R310. 6. The local code enforcement official has been consulted in this matter and supports the granting of a routine variance under the provisions of 19 NYCRR 1205.6. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because such would be unnecessary in light of alternatives which, without a loss in the level of safety, achieve the intended purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section AJ601.3, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the reduced headroom projections shall be marked or treated by applying a contrasting coloring in such a way as to call attention to the reduction. 2. That smoke and carbon monoxide detecting alarm devices shall be located within the basement, including in each major ceiling compartment, and interconnected to additional alarms in the dwelling above, in accordance with the 2020 Fire Code of New York State, 3. That an interconnected rate of rise heat detector shall be installed in the boiler or furnace room. 4. That an Emergency Escape and Rescue Opening shall be provided.
