SUBDIVISION (LOT MERGER) APPROVAL
FOR 545 1/2 WESTCHESTER AVENUE & 0 HAWTHORNE AVENUE
VILLAGE OF RYE BROOK PLANNING BOARD
WHEREAS, the Applicant Gary Gianfrancesco (the "Applicant', on behalf of the
Owner, Castanea, LLC, submitted an application seeking approval of a lot merger pursuant
to subdivision regulations concerning the consolidation of the properties located at 545 1/2
Westchester Avenue and 0 Hawthorne Avenue (SBLs 135.83-1-20 and 21, respectively) on
the Town of Rye Tax Map, situated in the R-2F and R-15A Zoning Districts (the
"Properties'; and
WHEREAS, the Planning Board is the Approval Authority for this application
pursuant to Sections 179-2.A(1) and 219-2.B of the Village Code of the Village of Rye
Brook; and
WHEREAS, the Planning Board reviewed the following plans and application
materials:
1. Short Environmental Assessment Form and EAF Mapper Summary Report, dated
February 15, 2024;
2. Application for Subdivision Approval, dated February 15, 2024;
3. Letter correspondence of Gary Gianfrancesco,AIA,AICP,LEED AP BD+C, dated
February 13, 2024,marked received on February 15, 2024;
4. Building Permit Checklist& Zoning Analysis;
5. Survey of property by Link Land Surveyors, P.C., generally entitled "Survey of
Property Prepared for Castanea LLC Situated in the Village of Rye Brook,Town of
Rye,Westchester County, New York, the contents of which were certified on
October 12, 2022;
6. "Merger& Reapportionment Map of Tax Lots Section 135.083, Block 1,Lots 20, &
21" by Link Land Surveyors, P.C., last revised April 9, 2024; and
7. Hardesty& Hanover Memorandum, dated March 29, 2024; and
WHEREAS, the application for a merger of the lots is a Type II Action pursuant to 6
NYCRR 617.5(c)(16) of the State Environmental Quality Review Act (SEQRA) thereby
requiring no further environmental review; and
WHEREAS, a duly advertised public hearing was opened on the subdivision
application on May 9, 2024, at which time all those wishing to be heard on the Application
were given such opportunity, and the public hearing was closed on May 9, 2024, and
WHEREAS, the Planning Board, Village Planning Consultant, and Village staff have
reviewed all application materials; and
WHEREAS,the Planning Board is fully familiar with the application and the property.
NOW,THEREFORE, BE IT RESOLVED, that the Village of Rye Brook
Planning Board hereby grants Preliminary Subdivision Plat Approval, as shown on the
application materials enumerated above.
BE IT FURTHER RESOLVED, the Planning Board hereby finds that the Final
Subdivision Plat will not be substantively changed from the Preliminary Subdivision Plat and
hereby determines that a public hearing on the Final Plat is not required.
BE IT FURTHER RESOLVED, that the Planning Board hereby grants Final
Subdivision Plat Approval concerning the application to consolidate the lots located at 545 '/2
Westchester Avenue and 0 Hawthorne Avenue (SBLs 135.83-1-20 and 21,respectively) on the
Town of Rye Tax Map, situated in the R-2F and R-15A Zoning Districts, as set forth and in
accordance with the revised Merger & Reapportionment Map, last revised April 9, 2024,
subject to the following conditions which must be satisfied prior to the signing of the Final
Subdivision Plat by the Planning Board Chairman:
1. The Applicant shall prepare a Final Subdivision Plat in accordance with Section
219-32 of the Village of Rye Brook Subdivision Regulations, which shall include
the Town of Rye tax lot designations for the subject lots. Upon obtaining a
satisfactory review by the Village Engineer/ Superintendent of Public Works, the
Final Subdivision Plat shall be submitted for review and signature to the
Westchester County Department of Health.
2. The Applicant shall submit a statement signed by the Town of Rye Receiver of
Taxes that all taxes due for both lots have been paid.
3. All applicable fees and professional review fees incurred in connection with the
review of this application shall be paid in full.
BE IT FURTHER RESOLVED, that this conditional approval of the Final
Subdivision Plat shall expire one hundred eighty (180) days from adoption of this resolution
unless all conditions set forth above have been certified as completed and the Final Plat has
been submitted for endorsement by the Planning Board Chairman, or unless a written request
for an extension of Final Subdivision Plat Approval is granted by the Planning Board. The
Planning Board may grant ninety (90) day extensions to said time period.
BE IT FURTHER RESOLVED, that once the Final Subdivision Plat has been
endorsed by the Planning Board Chairman, said plat must be filed in the Westchester County
Clerk' s Office within sixty-two (62) days. After said filing, two (2) hard copies of the Final
Plat and one electronic copy shall be submitted to the Village.
BE IT FURTHER RESOLVED, that no permits shall be issued until the Applicant
has paid to the Village all applicable fees and professional review fees incurred in connection
with review of this Application.

Review

Please note that our review is limited to planning and environmental issues. We offer the following
comments regarding the application:
1. SEQRA. The Proposed Action is a Type II action with regard to SEQR because it involves
and individual lot line adjustment.
2. Subdivision Plat. In accordance with Section 219-25.H(2) of the Village Subdivision Law, the
zoning district line should be shown on the plat and the following notation should be added,
"Existing zoning boundaries as of insert date), 2024."

Re: Lot Merger—545'/z Westchester Ave. and Hawthorne Ave.
Dear Mr. Goodman and Planning Board Members:
I am Gary Gianfrancesco of Arconics Architecture, P.C. We are the architects and
planners representing Castanea LLC with regard to this proposed lot merger. I also
recently became the owner of the subject parcels which are held by Castanea LLC.
The development of the subject properties predates the establishment of the Village
of Rye Brook. The building permit for the current site development was issued by
the Town of Rye in 1975-1976. The property was in an R2F-Two Family Residential
District. Permitted uses at the discretion of the Town Board allowed for two (2)
professional spaces and one (1) dwelling unit. The requisite parking of seven(7)
spaces was provided. A permit was issued to construct the new building and a CO
was issued for same.
While many surrounding buildings in this Zone have morphed into commercial uses
with dwelling units, to the best of my knowledge no other property was ever
constructed new under this Zoning provision.
I have enclosed the original drawing for which the permit was issued. The plot plan
shows the approved site development, which is how it existed for±48 years.
We are seeking to merely dissolve the lot line between the two lots and merging
them into one lot exactly as depicted on the permit drawing. The lot merger
