RESOLUTION CONSIDERING A HOLD HARMLESS AGREEMENT BETWEEN THE VILLAGE OF RYE BROOK AND DAN ZHU TO MAINTAIN EXISTING STRUCTURES IN A VILLAGE DRAINAGE EASEMENT WHEREAS,the Village of Rye Brook has an existing drainage easement at 5 Deer Run; and WHEREAS,the existing drainage easement at 5 Deer Run has existing structures including an outdoor barbecuelkitchen,deck steps,koi pond,retaining wall,chain link fence and stockade fence;and WHEREAS,the owner of 5 Deer Run Dan Zhu wishes to maintain the existing structures in the drainage easement;and WHEREAS,the Village of Rye Brook wishes to enter into a hold harmless agreement with Dan Zhu to allow the existing structures to remain in the drainage easement while holding harmless and indemnifying the Village,its officers,agents,contractors and employees from and against all claims and liability for loss or damage to the Premises,or any injury to or death of any and all persons that may be occasioned by the location. In any event in which the Owner fails to or refuses to reimburse the Municipality within thirty (30)days of written demand therefore,such amount shall be a lien against the Premises in the same manner as real property taxes. In addition, there shall be added to such amount interest thereon at the maximum legal rate and the cost of collection thereof, including reasonable attorneys fees. 5. Annette Pacelle purchased the Subject Premises from the original developer of the subdivision Ken Loewentheil —Rye Brook, Inc. by Deed dated November 24, 1987 and recorded in the Office of the Westchester County Clerk on December 15, 1987 in Liber 9058,Page 164 of Deeds. Over the course of 37 years Ms.Pacelle made a number of improvements to the outside of the premises without building department permits, which include installation of a concrete patio/sports court,an outdoor covered Kitchen,a Koi Pond and a shed Prior to the closing of the sale of the Subject Premises from Pacelle to Zhu,these improvements came to light by search of municipal records, and at the closing Pacelle became obligated to obtain certificates of completion for the various improvements and obtain all required variances necessary for them to remain. DRAINAGE EASEMENT The original subdivision map(Map No.2287)indicates a drainage easement for the benefit of the Village running along the northerly boundary of the Subject Premises. No formal easement agreement or declaration of easement was ever recorded for the easement. When it became apparent that the Koi Pond and outdoor covered Kitchen were located with the easement area, the Village requested that the current property owner sign a Hold Harmless and Indemnification Agreement to protect the Village in the unlikely event that the easement area ever needed to be excavated and the improvements were removed or damaged. AREA VARIANCE TEST In making its determination on an application for an area variance, the Zoning Board of Appeals shall take into consideration the benefit to the applicant if the variance is granted as weighed against the detriment to the health,safety and welfare of the neighborhood or community by such grant. In doing so, the Zoning Board must consider the 5-prong test for area variances as provided by the New York State Village Law. CHARACTER OF THE NEIGHBORHOOD The first prong of the test is whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the area variance. The subdivision where the Subject Premises is located contains very similar sized parcels and similarly constructed homes. The improvements requiring variances in this application have existed for many years without causing any detriment to the character of the neighborhood In fact, the koi pond,which is very small,and the concrete patio/sports court are not even visible to the other properties in the subdivision because they both have a zero profile from the ground level. Many, if not most properties within the Village have backyard sheds and outdoor barbecues/kitchens. Certainly, on parcels the size of the Subject Premises(15,623,600 sq. ft.)there are many outdoor improvements of the nature involved in this application that exist within this particular subdivision. Due to the fact that the improvements that are part of this application already exist and have been in existence in their current locations for many years,moving them within the required setbacks would be unnecessarily costly.
