These boulders are a safety hazard to vehicles and can cause serious damage and or injury. Your property has been observed as one of these properties. Per Code Section 186-2-A-3 (Excerpted below)you are being requested to remove these rocks from the right of way within 30 days of receipt of this letter. They can be placed on private property behind your property line. An inspection will be required to close out this notice. Chapter§ 186-2Trimming of brush and removal of hazards; notice to remove; removal by Village; costs. All rubbish, litter, leaves,twigs, branches, cuttings or other unsightly or objectionable materials which are or might tend to become health safety or fire hazards removed from such land.This subsection is not intended to prevent mulching and composting of materials originating on the property as long as such activities are not carried out in an objectionable, unsightly or unsafe manner. Dear Atria Rye Brook, The following violations of the Code of the Village of Rye Brook, and/or the New York State Uniform Fire Prevention & Building Code (NYSUFP&BC)were found to exist at the property above. DESCRIPTION 186-2A. Every owner, tenant, occupant or person legally in possession of real property in the Village of Rye Brook shall maintain such property in the manner provided herein and shall maintain the public property located between the property line and the curb or edge of the street or highway in the same condition as the property of which he or she is legally in possession. Such private and public property shall be maintained as follows: (3)All rubbish, litter, leaves, twigs, branches, cuttings or other unsightly or objectionable materials which are or might tend to become health, safety or fire hazards removed from such land. This subsection is not intended to prevent mulching and composting of materials originating on the property as long as such activities are not carried out in an objectionable, unsightly or unsafe manner. You are hereby directed to contact the Building Department, obtain all necessary permits and commence to correct the above-captioned violation(s) immediately. Violations of the NSYFP&BC must completely be remedied by July 15,2024, which is(30) days after the date of this notice and are returnable at the rate of$1,000.00/day for each day of the continued violation, or imprisonment not exceeding one year, or both. A RE-INSPECTION OF THE PREMISES IS REQUIRED BY LAW TO CONFORM COMPLIANCE WITH THIS NOTICE & ALL APPLICABLE CODES. FAILURE TO COMPLY WITH THIS NOTICE IS A CRIME PUNISHABLE BY FINE, IMPRISONMENT OR BOTH.
