A June 10, 2024 at 8:16:28 AM EDT Austrian Jonathan 39 Country Ridge Dr Rye Brook NY 10573 Notice of Violation - 39 COUNTRY RIDGE DR - 129.51-1-7 RE: RB-2024-010 water discharing onto neighboring property(golf course) Dear Jonathan &Shari Austrian, The following violations of the Code of the Village of Rye Brook, and/or the New York State Uniform Fire Prevention & Building Code (NYSUFP&BC)were found to exist at the property above. DESCRIPTION 186-3(B.) No owner, tenant, occupant or person shall direct or cause to be directed, stormwater, groundwater or water from any other source from one property onto another or onto a public right- of-way in a manner that results in a hazard or nuisance. You are hereby directed to contact the Building Department, obtain all necessary permits and commence to correct the above-captioned violation(s) immediately. Violations of the NSYFP&BC must completely be remedied by July 10th,2024, which is(30) days after the date of this notice and are returnable at the rate of $1,000.00/day for each day of the continued violation, or imprisonment not exceeding one year, or both. A RE-INSPECTION OF THE PREMISES IS REQUIRED BY LAW TO CONFORM COMPLIANCE WITH THIS NOTICE &ALL APPLICABLE CODES. Looking on Google maps, I believe the house numbers are 39 and 41. Over the past couple years, we have planted Spruce and Arborvitae trees along the property line for additional screening. Directly behind the house with the pool (39 Country Ridge Dr), three of these trees are in serious decline. I understand this is speculation but if the pool water is being drained onto the property it is potentially causing injury to our new plantings. It hasn't rained in several days of any significant amount and this area is extremely saturated, including standing surface water. Attached are a few photos showing the area of concern. In one photo you can clearly see a white drainage pipe pointed directly at our property adjacent to the fence. I am available most days throughout the week if you would like to visit our property.
