Petitioner has argued that it would be physically unworkable and financially burdensome to reconstruct the deck framing around the stair to comply with the code. 4. In that the subject stairs are not the means of egress and are part of a dwelling unit, used by individuals who are accustomed to their surroundings, the dimensional variation will not have a substantial negative effect and are considered de minimus.
