Relief is requested from: 19 NYCRR Part 1220, 2020 Residential Code of New York State, Section AJ601.3, Compliance, Exception 1, provided as follows: Space created in basements may have a ceiling that projects to within 6 feet, 8 inches of the finished floor; and beams, girders and ducts in such space or other obstructions may project to within 6 feet, 4 inches of the finished floor. [The petitioner requests relief for spaces in a basement with ceiling heights less than allowed.] FINDINGS OF FACT 1. The petition refers to the construction of habitable and non-habitable space in the basement of the subject building. 2. About 3/4 of the basement ceiling height is 7 feet 4 inches, however there is a rec room and soffit as low as about 6 feet 2 inches. This headroom exceeds the average height of adult persons according to anthropometric data found in the current NFPA 101 life safety code. 3. The basement floor is of concrete construction and the first floor is constructed with conventional wood floor joists. It would be physically impracticable and an unreasonable economic burden to raise the floor above or lower the slab below. In that the subject space is in a dwelling unit, used by individuals who are accustomed to their surroundings, the reductions to the height of the ceiling would not have a substantial negative effect on their health or life safety and are considered de minimus. 5. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205.6. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety and security. Strict compliance with the provisions of the Uniform Fire Prevention andi8-'dd'ng1g1 Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because such would be unnecessary in light of alternatives which, without a loss in the level of safety, achieve the intended purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section AJ601.3, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the reduced headroom projections shall be marked or treated by applying a contrasting coloring in such a way as to call attention to the reduction. 2. I don't believe Steve F. gave me the original at that time because he couldn't have definitively known - he had to check. Again, he was asking, not telling. He did tell me that one is required. In any event, Mike's characterization below is not completely accurate and it seemed like an important fact in light of what we're now being directed to do by 11/30 which, as Alice stated, is simply not possible. We were not expecting a threatening violation that we needed to apply for permits in less than 30 days or face significant fines ($1,000/per day) and a summons of court. We've done nothing wrong. This violation was issued out of nowhere yesterday. Background We bought our house in February 2002, AS IS. As the attached MLS listing indicates, the basement was finished when we bought the house. We did not do anything structural to the basement during the 20 years we have lived here. We received a clean CO and title at closing! 11110120 We were given an Inspection Report (attached) in November 2020 where we were advised during a mechanical inspection, after converting from oil to gas, that the finished basement required a certificate of occupancy. Please review this Inspection Report very carefully. There is ABSOLUTELY NO indication that anything had to be done during ANY specific period of time! Yes, we knew we would have to 6 address this at some point. But, as I hope you would appreciate, particularly at this time, there is a limited amount of funds! Since November 2020, we had to replace our siding, paint the house, and install a new roof. In September 2021, we had a leak in the shower pan of our main bath, so that also to be addressed. In fact, we held off repairing the bathroom for as long as we could, partly because of the expense and partly because of the challenge of hiring a reliable contractor (not to mention this was all during Covid). 7/21/21 & 7/22/21 We applied for a permit to replace our roof on 7/21/21 and the permit was issued on 7/22/21. The Inspection Report about the basement was never mentioned. December 2021 - Present We applied for a general work permit and electrical permit to repair our main bathroom. From the time I applied for the permit in December 2021 up until October 17, 2022 when I came to Village Hall to pay for the CO, I have been to the Building Office multiple times and spoke with both Laura and Tara to ask questions about the process and to acquire information to close our bathroom permit. I do know that my file was checked a several times to make sure all of the proper paperwork was in the file so I could get the CO. Again, at NO point was the Inspection Report ever brought up. Friday, October 28, 2022 Steve Fews came to do the final inspection for the master bath. He rejected the master bath because of the "open violation for the finished basement". To be clear... we NEVER received a Notice of Violation for the basement... It was noted on the 11/10/20 Inspection Report... and... if you look back at the Inspection Report... "Violation" was NEVER used! As you can imagine we were totally taken off guard on Friday. My Steve went to the Building Office and spoke with Steve Fews to better understand what was going on and how we would get the bathroom permit closed, especially since the end date for the permit is December 17, 2022. Steve Fews said that he would speak to you about our situation and that he would get in touch with us Monday to follow up. We truly were expecting a phone call to discuss our situation and how it could be resolved in a reasonable amount of time. As I stated above, we are completely blindsided by the violation! Please make time to meet with me this week. I work locally so if you give me a couple of options I will make it a priority.
