Subject: Site Plan Approval for 47 Hawthorne Avenue, Rye Brook, NY 10573
Hi Mike,
As you know, I have entered into a contract to purchase the zoning compliant vacant lot located at 47 Hawthorne Avenue
(ID#135.75-1-82). As such, I have a vested interest in this property and all associated applications and approvals.
It is my understanding the current owners (Mark& Mary Miller) received Site Plan Approval on January 13, 2022 to
construct a new two-story, single-family home. Please be advised that I have engaged my architect(Justin Minieri) to
explore alternative floor plans and the possibility of proposing site plan amendments for a smaller home. This work will
take some time to complete and will be pursued in earnest after the closing of the property has occurred. Please attach
this email to the Site Plan Application to serve as clear documentation of my inlWtions and desire to keep the application
approval in an active state while I complete my due diligence over the coming s. I will update the Rye Brook
Building Department as soon as tangible progress is achieved on this in tia e.
Many thanks for your assistance. I look forward to working with yo tniy future home!
Regards,
Greg Varone

Mr. Varone,
There is no process. An application is deemed dormant and abandoned if the Building Department receives no
meaningful contact from anyone associated with the application for a year. To keep it active you or your
design professional must keep in periodic contact with the Building Department, preferably through email.
Provide information and/or progress reports showing continued interest in moving forward and ask that the
emails be attached to the application so that anyone researching it can see that the application is still active.
That's it.

Subject: FW: Site Plan Approval for 47 Hawthorne Avenue, Rye Brook, NY 10573 (Update)
Hi Mike,
I am writing to follow-up on the attached emails and to inform your office that I closed on the purchase of 47 Hawthorne
Avenue, effective December 201h, 2022. My architect(Justin Minieri) is now working on plans to construct a home which
will be significantly smaller than the one which was previously approved by the Planning Board (for the prior owners) on
January 131h, 2022. 1 am hoping to have final architectural plans ready for review by early February, 2023. Please advise
as to the process I will need to follow in submitting proposed site plan amendments so that I can prepare all necessary
documentation in a timely manner. Please also attach this email to the Site Plan Application so that anyone researching it
can see that it is still active. Thanks for your assistance and best wishes for a happy holiday season!

HEIGHT/SETBACK RATIOS FOR RESIDENTIAL DISTRICTS
DEFINITION: A standard designed to regulate the height of a building in relation to the average grade of the corresponding portion of
the lot line from which it is set back. The ratio modifies the maximum permitted Height of Building by forming an inclined plane
beginning at the average grade along the portion of the lot line from which the setback is measured and rising toward the building at the
specified ratio above which no part of any building, other than minor architectural features such as chimneys, skylights and dormer
windows not covering more than 10%of the entire roof area, shall be permitted to extend. Height and Setback shall be calculated using
the formula; Height I Setback= X, where X is the required side or front yard ratio for the zoning district in which a property is located
as specified in Article VIII of Chapter 250. A complete elevation view for the proposed improvement must be included on the drawings.
