Short Environmental Assessment Form and EAF Mapper Summary Report; 2. Application for Site Plan Approval; 3. Site Plan Submittal Review Checklist; 4. Exterior Building Permit Application; 5. WHEREAS, the Planning Board is the Approval Authority for the Site Plan pursuant to Section 209-1.A(2)(a) and Section 209-1.B(9) of the Village Code; and WHEREAS, the Planning Board is also the Approval Authority for the Steep Slope Work Permit application pursuant to Chapter 213 of the Village Code; and WHEREAS, the Proposed Action is a Type II Action pursuant to 6 NYCRR 617.5(c)(12) of the State Environmental Quality Review Act ("SEQRA") thereby requiring no further environmental review; and WHEREAS, the Village Planning Consultant, Village Staff and the Planning Board reviewed the information, submitted comments regarding the site plan and steep slope permit and made recommendations concerning same; and WHEREAS, on June 8, 2023, the Planning Board opened a duly advertised public hearing on the subject applications, at which time all persons interested were given an opportunity to speak on behalf of or in opposition to said application and the Planning Board closed the public hearing on June 8, 2023; and WHEREAS, the Planning Board has considered the environmental impact of the proposed action, alternatives to the proposed action, the suitability and/or unsuitability of the proposed activity to the area for which it is proposed, the effect of the proposed activity with reference to the protection of steep slopes, and the availability of technical improvements, safeguards or other mitigation measures that could feasibly be added to the proposal; and WHEREAS, the Planning Board has considered the above-referenced Steep Slope Work Permit standards set forth at Village Code Chapter 213 and finds that the application complies with Village Code standards subject to compliance with the conditions as set forth hereinbelow; and WHEREAS, the Planning Board has considered the site plan review standards set forth at Chapter 209 of the Village Code and is familiar with the site and all aspects of the project. NOW, THEREFORE, BE IT RESOLVED, that for the reasons stated herein, the Village of Rye Brook Planning Board hereby approves the site plans listed herein and approves a Steep Slope Work Permit, for the proposed wood railing, boulder lining wall, bluestone slab steps and a re-grading of the property at the property located at 52 Bonwit Road, upon the following conditions: 1. The Steep Slope Work Permit shall be valid for a period of one (1) year from the date of this resolution and shall expire on completion of the acts specified therein,however, an extension of an original permit may be granted upon written request by the original permit holder or his/her successor, to the Planning Board at least thirty (30) days prior to the expiration date of the original permit unless waived upon good cause shown. 2. The Applicant shall submit a Construction Management Plan to the Satisfaction of the Village Building Inspector and Superintendent of Public Works/Village Engineer. 3. The Applicant shall delineate areas of steep slopes disturbance on the site plans and all work shall require compliance of all grading and filling requirements of Chapter 213 of the Village Code. 4. Any proposed plantings should be native and non-invasive species. Applicant shall replace the proposed Hachenacloa and creeping myrtle. BE IT FURTHER RESOLVED, that no permits shall be issued by the Building Department until the Applicant has paid to the Village all applicable fees and professional review fees incurred in connection with review of this Application.
