Circosta, Director of Public Works Date: November 1, 1994 Subject: ARBORS SEWER MAINS -------------------------------------------------------------------------------------------------------------------- I have recently received documentation from the Westchester County, Department of Health with regard to the ownership and maintenance of the sewer mains which run through the Arbors property. A review of this information, leads me to believe that the sanitary sewer lines are owned by the Village of Rye Brook and through a mutual agreement are maintained by the Arbors Homeowners Association. Some of the information which allowed me to draw that conclusion is listed below and attached hereto. • Letter from Daniel J. Donahue P.E. Associates, Engineers for the Westchester County, Division of Environmental Facilities, addressed to Dolph Rotfeld Associates dated May 11, 1977, wherein he states that the original approval of the "Harkness at Rye" was approved with the provision of public water and public sanitary sewer. He also states that in accordance with Article II of the Westchester County Sanitary Code, it is required that each building site be provided with an individual connection to a public sewer. • New York State, Division of Environmental Facilities, Form # BSP-5 entitled "Application of Approval of Plans for a Wastewater Disposal System" wherein under the section of applicant, both Berco-Rye Town Co. and the Town of Rye are listed. 0 Department of Health form entitled "Wastewater Disposal System Project Description" wherein, the Town of Rye is listed as the applicant and municipal ownership is listed as the type of ownership. 0 "Request for Service" dated July 11, 1977 from the Westchester County, Department of Health, wherein notes were made that the Town will own and the Town has agreements with Berco for maintenance on these lines. • An agreement by Berco Rye Town and the Town of Rye, dated July 21, 1977 wherein Berco agrees that the Town of Rye shall make repairs and maintenance of the sewer mains if the Homeowners Association fails to do so. t Continued/page 2 Memorandum/C.J. Russo November 1, 1994 Based on the information provided, I believe it was the intent of the Town Board at the time this subdivision was approved, that the sewers would remain in private ownership. However, once the application was made to the Westchester County, Department of Health, they were informed that the Sanitary Code required that the sewers be in public ownership. Thereupon, Berco-Rye Town made the attached agreement with the Town with regard to the maintenance issue so that the intent of the subdivision approvals was still in force. In closing, I believe that any future connections made to this system by the Village would be allowed, however, we may have to discuss the maintenance issue. To date this department has not yet, received such cartificatiaa. On August 15, 19781, this department received amfiltraticn test results from the office of Dolph Rotfald Associates; however, in his covering lett4w, be states that his services were the monitoring of the test conducted by tba contractor and does not make reference to the supervision of the contraction. please note that based up=, this department cannot accept this project as complying with the conditions of the approval and placing in operation of these sewers cam be construct as a violation of the tern of the approved and Article 17 of the lnvirvcmental Conservation Lae.
