Most of that fence has been removed and some of the remnants are stacked in the rear yard behind the gazebo at 32 Bonwit Road. The remaining standing portion of the fence at the east elevation sits atop a wood tie retaining wall as did the rest of the fence at some point. As also depicted in the photo, the exact type of fence/wall exists on the neighboring property at 34 Bonwit Road. Based on my site observations, the attached survey, and Village records which show that at one point in time both 32 and 34 Bonwit Road were owned by the same person, it is my professional opinion that the fence and the wood retaining wall on 32 Bonwit were at one time not only aligned with the existing fence and wall at the neighboring property, 34 Bonwit Road, but were actually connected to one another as one continuous structure. When the portion of the wall at 32 Bonwit collapsed, the fence was also damaged and hence removed. This conclusion is further supported by the wall and fencing materials themselves which are identical on both properties. As such, the Village's position is that the collapsed wall in question is the responsibility of the property owner of 32 Bonwit Road. To that end, yesterday I posted the wall as unsafe and condemned by the Building Department. I have also placed the property owner on notice that there now exists a violation on this property for failing to properly maintain the retaining wall. I'd like to remind you that we had been delayed last month because the town police stopped permitted work on my project. We were taking down a tree that needed to be removed in order to build the wall. The way in which the issue was resolved was by my agreeing to plant new trees on my neighbor's property (something I was willing to do to keep the peace, be a good neighbor and respect the wishes of the town). We are willing to go so far as to offer a guarantee that the wall will start by a certain date if you allow the footing inspection and the pouring of the foundation this week.
