HomeMy WebLinkAboutBP17-170 July 13, 2017 _APPROVED 5-0__ RESOLUTION GRANTING SITE PLAN APPROVAL FOR 21 ELM HILL DRIVE VILLAGE OF RYE BROOK PLANNING BOARD WHEREAS, Mr. Malek Samad, property owner, submitted an application for approval of a site plan to demolish the existing single-family home and construct a new two- story single-family home and attached garage, rear-yard patio, new driveway with parking/turn-around area, walkways and a new curb cut at 21 Elm Hill Drive in the R-12 District, Section 135.50, Block 1, Lot 42 as shown on the Town of Rye Tax Map; and WHEREAS, the Planning Board is the approval authority for the application pursuant to Sections 179-2.A(2), 209-1.A(2)(a) and 209-1.B(1) of the Village Code; and WHEREAS, the Planning Board reviewed the following plans and application materials: 1. Short Environmental Assessment Form and EAF Mapper Summary Report dated June 12, 2017 2. Application for Site Plan Approval 3. Site Plan Submittal Review Checklist 4. Architectural Review Board Check List for Applicants 5. Exterior Building Permit Application 6. Construction Management Plan, prepared by DeMotte Architects, Ridgefield, C.T. dated May 9, 2017 7. Letter to the Planning Board from DeMotte Architects, Ridgefield, C.T. dated June 19, 2017 8. Letter Requesting Waivers from Site Plan Checklist Items, from DeMotte Architects, Ridgefield, C.T. dated May 9, 2017 9. Photographs of the Existing Home and Adjacent Homes 10. Architect’s Plans, prepared by DeMotte Architects, Ridgefield, C.T.: SP-1 Site Plan 5/9/17 SDP-1 Site Demolition Plan 5/9/17 1313/236/603649v1 7/20/17 LA-1 Landscape Plan 5/9/17 rev. 6/19/17 A-1 Basement Plan 5/9/17 A-2 First Floor Plan 5/9/17 A-3 Second Floor Plan 5/9/17 A-4 Roof Plan 5/9/17 A-5 Front Elevation 5/9/17 A-6 Right Side Elevation 5/9/17 A-7 Rear Elevation 5/9/17 A-8 Left Side Elevation 5/9/17 A-9 Building Section 5/9/17 A-10 Building Height/Setback Ratio 5/9/17 WHEREAS, on the Proposed Action is a Type II Action requiring no further review pursuant to the requirements of SEQRA; and WHEREAS, the Village Planning Consultant, Village Staff and the Planning Board reviewed the information, submitted comments regarding the site plan and made recommendations regarding stormwater, tree removal, visual impacts to adjacent properties and exterior lighting; and WHEREAS, on July 13, 2017, the Planning Board opened a public hearing on the subject application, at which time all persons interested were given an opportunity to speak on behalf of or in opposition to said application and the Planning Board closed the public hearing on July 13, 2017; and WHEREAS, the Planning Board is familiar with the site and all aspects of the project. NOW, THEREFORE, BE IT RESOLVED, that upon recommendation of the Village of Rye Brook Superintendent of Public Works/ Village Engineer, and Village of Rye Brook Planning Board hereby approves waivers requested by the applicant from the requirement for the submittal of the information identified on the Site Plan Submittal Review Checklist and Development Review Checklist noted with a “W” thereon by the applicant. BE IT FURTHER RESOLVED, that for the reasons stated herein, the Village of Rye Brook Planning Board hereby approves the site plan listed herein, to demolish the existing single-family home and construct a new two-story single-family home and attached garage, rear-yard patio, new driveway with parking/turn-around area, walkways and a new curb cut at 21 Elm Hill Drive, on the condition that the proposed stormwater overflow shall tie into the Village stormwater system. 1313/236/603649v1 7/20/17 BE IT FURTHER RESOLVED, that no permits shall be issued by the Building Department until the Applicant has paid to the Village all applicable fees and professional review fees incurred in connection with review of this Application.
