Good Morning Mr. Izzo,
This whole incident is becoming ludicrous, and causing undue stress to my 92 year old Mother. Let me just state all the
facts again, maybe it will help you in closing this affair out.
The neighbor diagonally on Hillcrest (In Rye Brook) behind 174 Fairview Ave decided to move his stockade fence back a
foot. He (Freddy, personally) told me his property line went back another foot, and he wanted more space in his
yard. In moving the fence back, he drove the pilings in against our neighbor's retaining wall. He also had built over time:
a pool, a gazebo (with concrete or thick slate flooring and sandbag support) and a shed addition onto his house, all
apparent violations before the Rye Brook Building Dept. Not to mention he turned the fence around, so the "bad" side
faced out to our neighbors.
Concurrently, the neighbor behind us on Hillcrest has a giant oak tree in their back yard close to our retaining wall. The
roots were causing our wall to buckle and crack and lean forward. We were in the process of having it
repaired/replaced. This was on the left side (looking at our wall), not adjacent to 174 Fairview Ave, but to 168 Fairview
Ave. Then suddenly Hurricane Ida hit. Our wall (the left side) came down, the right half closer to our neighbor at 174
was intact. The wall in 174 came down from the middle out, the picture shows this. There is no way our work on the
left side of the wall (closer to 168 Fairview) caused the 174 Fairview wall to collapse, especially from the middle. It is
clearly evident from these pictures, that the driving in of the pilings from moving the fence on Hillcrest to the wall on
174 Fairview caused the wall to collapse during Hurricane Ida, along with the gazebo flooring. In fact
our neighbor at 174 told me she saw pipes from this neighbor funneling run off to their property line.
Ida also caused railroad ties our previous backyard neighbor had installed above our wall (raising their property at least
two feet higher), to buckle in. We ended up having to replace our whole retaining wall higher to hold back the dirt
behind those collapsed railroad ties. The new wall is installed inside our property line on exactly the same base as
before. In fact our retaining wall was, and is, in a foot from the retaining walls on both sides of our neighbors, not

adjacent to either of them. We had absolutely nothing to do with our neighbor's wall collapsing. Our neighbors at 174
Fairview are in complete agreement. It was solely the cause of the Hillcrest neighbor moving and driving his fence posts
against the 174 Fairview Ave wall, and Hurricane Ida pouring water down from Hillcrest onto Fairview's lower grade. He
does not want to admit he caused the collapse, precipitated by Hurricane Ida, and is attempting to push the blame on us
My family has lived in 170-172 Fairview Ave for over 66 years, and have always gotten along with all our surrounding
neighbors, except for the recent issues with the Hillcrest neighbors. In addition, we have always tried to keep our house
and property in a good and pleasing condition. We have never had any violations, nor have we ever made any structural
changes or additions to the house and grounds,just cosmetic adornments and replacements.
This whole baseless accusation is causing unneeded stress to my 92 year old Mother, as she just tries to enjoy her home
in peace and quiet.
Thank you for your help and consideration in closing out this disturbing and completely falsie allegation.
