LANDSCAPE CONTRACTOR a C E U Address: 490 Ellendale Avenue, Rye Brook, NY 10573 DEC - 8 2006 Original Business Start Date: 1/1/1985 RYE BROOK Principal: Antonio Greco, President BUILDING DEPC Phone Number: (914) 934-8567 Additional phone numbers: 914-261-4512; fax #: 914-934-7565 Type of Business: Lawn Maintenance Grievances for 490 Ellendale property: Business runs 7 days a week, 360 days (estimate) per year! • Hours of Operation: From dawn 'til dusk (Summer: 6:15A-7:15P; Winter: 7:15A- 4:30P) • 3 large trucks + trailer is housed at 490 Ellendale; more trucks parked at 495 West William Street • Trucks are parked in the open, not in garage • Truck engines are turned on and left to idle 10 minutes before departing property (at approximately 6:15 a.m. in summer and 7:15 a.m. in winter) • At the end of the day (or whenever!), trucks return to the property by reversing down a narrow driveway. This triggers the reverse beeping signal required by law in trucks that size. This beeping continues for approximately 80 feet per truck. Trucks have to stop and realign themselves to avoid hitting the house, thus prolonging the parking (and beeping!) process • Trucks are repaired on site (engines revving, clanking, etc.). Landscape Contractor Dear Judge Provenzano: I understand that Antonio Greco is requesting an adjournment of his July 31, 2007 appearance date. For the record,the Village is withholding its consent to this adjournment due to ongoing nature of the violations for which Mr. Greco has been cited. Mr. Greco was last before this Court on June 6, 2007 when he plead guilty to the same violations,to wit Rye Brook Code §§ 186-5 (commercial vehicles in a residential district); 186-4 (prohibited storage of construction material); 250-6(off-street parking); and 250-25 (commercial business in a residential zone). These violations stern from Mr. Greco's operation of a commercial landscaping business out of his residence, 495 West Williams Street, and his grandfather's residence, 490 Ellendale Avenue. On June 6, 2007, Mr. Greco was assessed $125.00 per violation for a total of $500.00 subject to an inspection the following day. The inspection revealed the violations had not been fully cured. After allowing Mr. Greco over one month to remove the remaining building supplies and commercial vehicles from the residential premises the violations continued thus precipitating the current violations. The Building Department has been receiving complaints regarding the commercial activity at Mr. Greco's premises as well as his grandfather's premises, 490 Ellendale Avenue, since at least February 2007. Unfortunately at the last court appearance the Judge elected to take the defendant at his word that the trucks were gone and that the violations had ceased. The defendant was suppose to contact me prior to the Court date for an on site inspection. He obviously did not do this because he was trying to keep using the property for his business up to the last minute. The Judge reasoning was to just get this case over with let him pay a fine, and if he continued I would have to serve him papers all over again. This truck does not seem to be in use on Sunday as it stays parked in the space all day. (In the past three trucks were parked there, now it seems to be one.) • The garage is still used as storage. One or two trucks come late in the afternoon, unload and leave. witnessed this activity on Saturday between 4:00-5:00. I'm now sure if this also takes place during the week since I am not there. I assume if they unload then they must come to load equipment or supplies into the truck(s) at other times during the day or week.
