Unfortunately that version needed additional information related to naming a primary and alternative contact, a revised descriptive emergency equipment listing with floor plans, and our waste removal vendor's audit packet. Please review and accept this revised 2023 Contingency Plan for CBLPath, Inc with the effective date of 12/16/2022 and discard the previous plan dated 12/2/2022. If we do not hear from you by January 1, 2023 our company will assume that you will graciously respond to our facility in the event of an emergency or chemical spill when dispatched. Every hallway, boardroom and most laboratories have strobe lights and alarms when activated. Urmacher,MD 12/16/2022 Facilities Managing and Laboratory Director 2.PURPOSE AND SCOPE OF PLAN Although this facility is designed,constructed,maintained and operated in a manner that minimizes the possibility for emergency incidents such as fire,explosions and any unplanned sudden or non-sudden release of hazardous waste or hazardous waste constituents to air,soil or surface water,this plan is designed to minimize hazards to human health and the environment in the unlikely event of such incidents.This plan is designed to satisfy the requirements of RCRA, NYS EPA,DEC,OSHA,CAP,and NYS DOH Regulations. 3.OVERVIEW OF FACILITY OPERATIONS,WASTES,AND PROCESSES GENERATING WASTES CBLPath, Inc.is a pathology laboratory. We diagnose cancer and other diseases of the human body. In the process of creating slides from human tissue,our laboratory uses the following chemicals mainly: xylene,alcohol,and formalin. These are hazardous wastes and we are a large quantity generator. We recycle a portion of these chemicals and use a licensed transporter to remove said used chemicals for processing and proper disposal. 4. This Committee meets regularly in-house or by Zoom.CBLPath's laboratory located at 760 Westchester Avenue, Rye Brook NY is within an established fire protection district in the Village of Rye Brook. When we dial 9-911 from our facility(we must dial 9 first to get an outside line from a land line phone), we have an arrangement with the Village of Rye Brook EMS, Police and Fire Department that they will come out to our facility in an emergency and service whomever and whatever needs help/servicing. Correspondence letters along with a copy of our contingency plan to our local emergency responders emergency responders. 6.SPILL CONTRACTOR AND EVACUATION PLANS Our spill contractor for large scale spills-is CHEMTREC. Our emergency in house personnel and safety officers have been spill trained to know that this contractor is called anytime there is a large quantity spill that is unmanageable(over one liter or noxious). In the event of a large spill all employees will be instructed to evacuate. The emergency responders who respond to our facility will be escorted by one of our emergency coordinators to the area identified who will come equipped to deal with the appropriate chemical hazard and type that is called in to their dispatch day or night.Additional employee safety policies related to spills and other facility emergencies including evacuations can be found on site in our safety and facility standard operating procedures. Evacuation floor plans can be found in the attachments. 7. LOCATION OF 90-DAY AND SATELLITE ACCUMULATION AREAS CBLPath, Inc.does not have a 90-day or satellite accumulation area for hazardous chemical storage or waste at our facility. All waste is stored on site for 2 to 3 weeks maximum and then removed by a certified and licensed waste hauler currently CleanEarth and Republic Environmental Systems Transport Group. 8.EMERGENCY PROCEDURES AND RESPONSIBILITIES Our CBLPath, Inc.emergency coordinators are trained to: • Be onsite or on call at all times to coordinate emergency response activities • Be intimately familiar with the contingency plan,the operations and activities occurring at our facility,the physical layout of our facility,the location and characteristics of wastes generated, stored and/or managed onsite,and the location of all records necessary to implement this plan • Know to activate all facility alarms to alert facility personnel of an emergency • Notify CHEMTREC as written in this plan 4 • CBLPATH Prepared By: TITLE: DOCUMENT NO.: Jules Laino Vice President of Quality Contingency Plan SOPM CON-001 Institutional Assurance,Integrity and Compliance IAIC DATE: 8/10/2010 REVISION: H-5 REVIEWED BY: APPROVED: EFFECTIVE DATE: Alvaro Galicia, C.Urmacher,MD 12/16/2022 Facilities Managing and Laboratory Director • Identify the biological,chemical,and physical properties of any released material,the source of the release,the amount released,and the areal extent of the material;environment that may result from the incident and identify threatened resources and receptors • Determine if the incident could threaten human health or the environment outside the facility and if evacuation of local areas outside the facility is required • Notify the National Response Center 1-800-424-8802 as needed All reporting must include: ■ Name and telephone number of the person reporting the incident ■ Name/address of the facility ■ Time and type of incident ■ Name and quantity of materials involved,to the extent known ■ Extent of injuries,if any ■ Possible hazards to human health or environment outside the facility • If facility operations cease,emergency responders will monitor for leaks, pressure buildup,gas generation,or ruptures in valves,pipes and other equipment will be required by a certified licensed vendor • After an emergency utilizing the services of ChemTrec get a full report of their services and clean up activities • Ensure all wastes are managed and disposed of in accordance with Federal,State and Local requirements • Ensure that no waste incompatible with the released material is processed until cleanup procedures are completed • Ensure that all emergency equipment is cleaned and fit for its intended use before operations are resumed • Coordinate with Federal,State and Local regulatory agencies to determine that appropriate response actions have been successfully completed and terminate emergency response • Provide details of the incident to the Owner/Operator and notify them with emergency response has terminated and that all emergency equipment is ready for use and the environment is safe for operations to continue Owner/Operator responsibilities: • Notify the NYS Department of Public Health and Safety,the EPA and the appropriate local authorities that the facility has implemented the contingency plan and is in compliance with the requirements of the plan before operations are resumed; • Record the time,date and details of the incident in the facility files; • Submit a written report to the authorities within fifteen days of the incident that includes: o Name,address,and telephone number of the owner/operator; Marshals will assist in the implementation of this plan by understanding and communicating evacuation routes to occupants(visitors and staff)during an emergency evacuation,that all evacuation routes are clear and to ensure that every person on his/her floor or area has been notified and evacuated.The Marshals must ensure that all office/lab doors are closed and that all bathrooms/closets/cubicles/common areas and the like are checked and they are the last ones out. Upon leaving the floors,the Marshals will report the status of the floor evacuation to the Director of Facilities and Safety Officer immediately before going to their muster station so that this information may be conveyed to the Fire Department. The Director of Facilities and Safety Officer will ensure all employees are at a safe distance from the building(at least 150 feet)and a Marshal wave off will take place to denote that everyone has evacuated his/her areas. In the case of severe weather or acts of terrorism,the Director of Facilities will communicate the safe haven location to occupants and report the status of occupant evacuation to the safe haven to the Safety Officer and officials(police,fire,first responders,etc.). Marshals will also assist the Director of Facilities in monitoring radios and other emergency communication devices if necessary. PREPARATION&PLANNING FOR EMERGENCIES: Pre-planning for emergencies is a crucial element of this plan.The following steps have been taken in planning for emergency evacuation of 760 Westchester Avenue: 1. All exits are,lighted,labeled and operable. 2. Evacuation route diagrams have been approved by the Safety Officer and Safety Committee and are posted on all floors,and by elevator areas. 3. Occupants do not block exits,hoses,extinguishers,corridors or stairs by storage or rearrangement of furniture or equipment.Good housekeeping is everyone's responsibility. 4. All Marshals have been trained in their specific duties and all building occupants will be instructed in what to do in case of an emergency evacuation. 5. Fire evacuation drills are held at least annually and are critiqued and documented.Prior to holding a fire evacuation drill where the alarm is to be triggered,the Rye Brook Fire Department is notified. EMPLOYEE EVACUATION PROCEDURE: l. In the event of a fire drill or actual emergency,the Marshals(both primary and alternates)will put on their fluorescent hats and immediately begin to do a"sweep"of their assigned areas to look for employees that need to be vacating to a muster zone. All employees must leave the building,regardless of whether it is a drill or actual emergency. 2. The sweep occurs with the Marshal going to each assigned room door to door,making sure occupants have vacated the room closing the door and making sure they all vacate the building using the stairs and exit doors only(NO ELEVATOR). 3. When the"wave off'goes completely around the building and goes back to the#1 Fire Marshal,they will let the Facilities Director know that the"wave off'is complete. Facilities Director will then either sound the hom once or wave a flag to signal that a drill is complete.Employees must wait for instructions from first responders or Facilities Director re:whether it is okay to return to the building,and after being told that it is,will sound the air hom twice for an all clear.All drills must be timed and evaluated for the Safety Officer and Committee review. FLOODS OR OTHER NATURAL DISASTERS: 1. In case of a serious flood warning,the Director of Facilities or Safety Officer will advise if an evacuation is necessary.The Director of Facilities or Safety Officer will notify Marshals and their employees of the need to take shelter via word of mouth. FIRE,CHEMICAL SPILLS AND SPILL CONTAINMENT: Fires and chemical spills can be life threatening,therefore,it is imperative that safety precautions,safety safeguards,and good common sense come into play in the laboratory at all times. In the event of a chemical spill,quick thinking and assessment are key. The Laboratory Supervisor,Manager or Director of Facilities should be immediately notified at all times and as quickly as possible. After that is done,the following should be completed: Level I Emergencies a. If the spill is considered non-caustic,not fire causing,and vapors are minimal secure the area and notify the emergency response team to assess the situation.For small controllable fires grab a fire extinguisher and initiate PASS. b. Place the spill signage around the area and employees around the spill area must be informed so that they do not step in the spill. c. Using appropriate PPE immediately contain the spill using a spill pillow,spill blanket,or vermiculite. The appropriate spill neutralizer can be found in any of the CBLPath spill cabinet locations. d. Once the spill is contained,the neutralizer should be swept up and disposed of in a red bag. e. An incident report must he filled out and given to the Facility Director for documentation. Level 11 or III Emergencies a. Evacuate all employees that may be in danger and contain the area(close doors).Call 9-911 and notify the emergency response and management teams. b. TERRORISTIC THREATS OR ACTIVE SHOOTER If you receive a terror threat,carefully note all information the caller gives you(request,location of the bomb,time the bomb is set to go off,exact time and duration of the call,any background noises at the caller's location,any voice characteristics like male/female, accent,speech particularities,etc.).Call 9-91 l immediately and then notify the Director of Facilities,Safety Officer and an executive.We may use the fire alarms as an evacuation means for other emergencies.If an evacuation is necessary the Marshals will conduct their duties as outlined above EXCPET in an active shooter situation.If you are in immediate danger go to a safe area and hide(please refer to safety training BLR modules for further instructions). Occupants must report to the authorities any observation or report of a suspicious person or package seen in the work areas or along the evacuation route.Occupants will not attempt to inspect or move suspicious packages or engage an active shooter situation. GENERAL EVACUATION INSTRUCTIONS 1. Anyone who receives information or observes an emergency situation should immediately call 9-911 and activate the building notification system(emergency response and executive teams). 2. Occupants will be notified of emergencies by fire alarm,text,and phone and/or by word of mouth. 3. Know at least two exits from the building. 4. We receive surgical biopsy specimens to diagnose cancer and other human diseases. In order to process these specimens our laboratory uses and stores bulk chemicals (approximately 600-1000 gallons at a time) of xylene, alcohol, and formalin. These chemicals are considered hazardous and because of the volume on hand (both fresh and waste)we are considered a large quantity generator of hazardous waste. We do recycle a small portion of xylene as part of our waste reduction program and use a licensed transporter to remove said waste chemicals for processing and proper disposal. The building is 66,000 square feet and consists of three floors with one unoccupied penthouse used for minimal storage. Each floor is equipped with a wet-sprinkled system throughout and monitored twenty- four hours a day by a central station. The monitoring system,with battery back-up, utilizes phone lines in the event of a utility outage. Any detection of a pressure drop in the system will trigger the monitoring system. Alarms are reported directly to the Fire Department and to the 760 facility emergency coordinator contacts as well as the facilities staff located at 800 Westchester Avenue, Rye Brook, NY (Landlord). Each floor has emergency pull boxes mostly located at stairwells and tested by our local fire marshal. Every hallway, boardroom and most laboratories have strobe lights and alarms when activated. The floors have two stairways at opposite ends of the building with exit signs that are in full view and well lit.There is an employee and service elevator(one) but deactivated during an emergency or drill. Potential personal injuries are a threat in the case of a large scale chemical spill or fire. Physical burns would be common if exposed to flames and/or the heat of combustible and flammable materials as well as from a small number of chemicals (acids) being stored. Inhalation of chemical fumes in the case of a large scale spill or fire is a real possibility. Please review and accept our 2023 Contingency Plan for CBLPath, Inc. If we do not hear from you by January 1, 2023 our company will graciously assume that you will respond to our facility in the event of an emergency or chemical spill when dispatched.
