Building Inspector,Village of Rye Brook: Date: NOV — 6 2023 RECEIVED VILLAGE OF RYE BROOK SEP - 7 2022 ZONING BOARD OF APPEALS VILLAGE CLERK'S OFFICE RESOLUTION WHEREAS, an application has been made to the Zoning Board by Daniel Debari & Catherine Debari (the "Applicants") for (1) a rear yard setback variance of 3.9 feet where the minimum required rear yard setback is 26 feet as granted by the Zoning Board of Appeals on May 18, 1998, and (2) a gross floor variance of 1,029 square feet where the maximum allowable gross floor area is 2,975 square feet pursuant to Village Code § 250-21.E,in connection with the proposed one story addition,and creation of new laundry room,legalization of rear yard setback, and legalization of gross floor area, on the property located at 11 Elm Hill Drive,in an R-12 zoning district on the east side of Elm Hill Drive, approximately 80 feet from the intersection of Hills Point Lane and Elm Hill Drive. The application is #22-024 and the Notice is dated August 2, 2022. Regarding the variance request to exceed the maximum allowable Gross Floor Area (GFA The original house, believed to be constructed in the 1860s, has been added onto several times, with the most recent addition occurring in 1998. At the time of this work, there was no maximum GFA requirement in place. This has now led to the GFA becoming a "non- conformity" with the more recent zoning requirements added to the Village code. We feel that a contributing factor to this non-conformity is the fact that the modern additions to the original 1860s house are all constructed on slabs and crawl space. Whereas most homes within the Village contain useable "basement" spaces, the house at 11 Elm Hill does not contain any such spaces. This is significant for two reasons. The first is that all useable living and utility space is forced to be contained within the first and second floors. The second is that basements, as defined within the Village zoning code, do not contribute to a home's gross floor area. As an example, a basic 3,000 square foot home that complies with the GFA requirement may often have as much as 1,200 square feet of additional useable floor space that does not count towards the GFA requirement, essentially allowing this example house to live like a 4,200 square foot house that still complies with the code. Since 11 Elm Hill does not have any usable basement space, which would not count towards its GFA, this creates a hardship for accommodating a reasonable program of living and utility spaces within the allowable GFA. The addition of this very modest Laundry Closet (only 26 sf of additional GFA) will help to alleviate existing storage and utility issues within the existing house that cannot be accommodated in any other way. Regarding the variance request to reduce the required rear yard setback: As noted in the Notice of Disapproval, a variance was previously granted allowing reduction of the rear setback to 26 feet. At the time of the work and prior approval, in 1998, the project evidently exceeded this granted allowable setback with a final rear yard setback of 22.1 feet. We respectfully request that the Board grant a new rear yard setback variance that matches the location of the pre-existing house which would also allow for the construction of the proposed addition. It should also be noted that the proposed new addition will sit entirely within the overhang of an existing porch roof that is to remain. Visually, then, there will appear to be only a very minimal change to the exterior perimeter of the house.
