Thank you for the email.
Upon my completion of the first progress inspection, I offer the following comments:
Thank you for coordinating the inspection and inviting the key members of the Hidden Falls HOA to be
present. I was impressed with your progress thus far in removing the encroachments from HOA property. I
realize we still have several issues which must be addressed including the remaining partially encroaching
shed, and the other non-permitted sheds present on your property.
To that end and given your substantial progress thus far, the Village is amenable to extending the compliance
deadline to Friday,July 29, 2022. Please continue to proceed curing the encroachment issue and initiating
the legalization process such that you achieve satisfactory compliance on all violations on or before that date.
Please remember to contact our office to schedule a follow-up inspection as further substantial progress is
made.

Dear Mr. Izzo: Just wanted to give another progress report that 2 more sheds are gone. The two that
remain one is in my driveway and the other on the far side of the yard. The driveway one is our property
for sure and the other one probably is. In no one way do they impact Hidden Falls at all, not far back not
in the woods at all. Therefore, should we plan on an inspection on Tuesday? We will try to rake and
manicure as much as possible over the holiday weekend. Regardless, the progress is substantial and as
senior citizens we could not done more with such a short time frame. Do we call Hidden Falls for them to
come as well? We have more debris being hauled out of here today as well. We are way over$10,000
to comply and that is all we are trying to do is rectify our wrongs. The time frame was and is the problem
as we have next week left. Please advise us if we should make an appointment for Tuesday for you to
see leaving time to fix things if needed further. The sheds remaining we presume we need to apply for
permits before next Friday but if you feel they will be denied we will demo those instead. This is why we
need to know when the right time is for you to come and still have time to be 100% in compliance before

Rye Brook doesn't have a dumpster permit. You can have as many dumpsters as you need.
You can put as many sheds or as much debris as you want in the dumpsters as long as the full
dumpsters are removed from the property when full. .

Dear Mr. Izzo: Sorry to bother you but need further clarification after speaking to Charles McGuire
regarding the conversation you had with him today. While we discussed two sheds, pool, and fence we
need to demo as needed whatever fits in the dumpster. Is it ok to put other sheds in that dumpster if
room? Do we need further permits for a second dumpster? It is an evolving situation and a start is not
what we are looking for but a final completion of all removals. I hired these men to start early this week
not realizing how long the process is and with how short our timeline is can we include as much as
possible or does it all have to be on that permit we discussed? We are running out of time and want to
get rid as much as we can but we thought that was all that could fit in one dumpster. Please clarify what

Re: Illegal Construction—Notice of Violation#E 1404
Dear Mr.& Ms.Chamey,
It has come to the attention of the Building Department that multiple construction initiatives have taken
place without permits and in violation of Village & NY State Codes on your property and on property
annexed and being utilized by you,but owned by the Hidden Falls Homeowners Association,your adjacent
neighbor.
Attached hereto are photographs of your property and of property owned by the Hidden Falls HOA provided
to our office by the Office of the Tax Assessor showing multiple structures under your control and intended
for your use for which no permits exist. These non-permitted illegal structures include but are not limited
to a circular fenced-in area resembling an above-ground swimming pool on Hidden Falls HOA property,at
least eight (8) detached accessory buildings, two (2) of which are on Hidden Falls HOA property, and
privacy fencing installed on Hidden Falls HOA property,to name a few.
By way of this letter and attached Notice of Violation #E 1404 you are hereby directed to immediately
demolish and/or remove all illegal structures& materiaWdebris from the Hidden Falls HOA property and
to schedule an inspection of the property with the Building Department to confirm compliance. You are
further directed to file for permits to either demolish/remove all the unlawful structures from your property,
or file to legalize them, if possible, in the manner prescribed by law.
Be advised that failure to comply with this notice by no later than June 24,2022, which is thirty(30)days

Thank you for the email.
Unfortunately, the thirty (30) day notice is non-negotiable at this juncture. Furthermore,you now have
additional violations against you as outlined in the attached Notice of Violation #E1405. However,your
request will be considered for both Notices if satisfactory progress has been made by you to cure all the
violations by the June 24,h or July 15'deadline.
To that end, I advise you to initiate removal of all encroaching structures immediately. I further advise you to
retain the services of a NY State Registered Architect or NY State Licensed Professional Engineer to assist
you in determining the number of accessory buildings your property can support by code. That number is
based on many factors including; the size of the property, the existing impervious coverage on the property,
the existing lot coverage of your property, the locations of the sheds, the sizes of the sheds, whether the sheds
are equipped with utilities like electric or plumbing, the manner of installation of the sheds, and other factors
which must be calculated and represented on the permit application(s) and on a proposed site plan by a
licensed professional. In the alternative you could simply remove all the sheds from your property.
It is in your best interest to immediately schedule a site inspection of the property with the Building
Department, and to continue to keep us updated with your progress towards curing all violations by
scheduling regular site inspections as progress is made.

Subject:the charneys 5 wilton circle re letters of violation received this weekend.
Dear Mr. Izzo: Jeff and I responding ASAP as we were away this weekend and the letters came while we were not
home. Hence,we are responding and have lost a week in the process between mailing and receiving these letters. I
spoke to the lawyer of Hidden Falls who told me he has no problem with a time extension to comply with the issues. We
want only to comply free from threat of a fine or a lawsuit. However Jeff is 74 and we are not physically able to comply by

June 24. We would appreciate an additional two months and rest assured all will be done. We need to know how many
sheds are allowed on our property so we can apply for the permits if needed. Also, we want to double check the two that
are on Hidden Galls property as these sheds pre-date the existence of Hidden Falls as we have lived here since 1978, 42
years! We are very sorry for causing any problems and only want to make this right. Our home phone is 914 939 7656 or

Subject: Illegal construction on Hidden Falls HOA property
Dear Mr. DeVito,
It has come to my attention that one of your neighbors at 5 Wilton Circle whose property abuts Hidden Falls
HOA property has constructed multiple sheds and a circular fenced-in area resembling an above-ground
swimming pool on Hidden Falls HOA property, all without permits and in violation of multiple sections of
Village Code. Please review the attached Notice of Violation, letter to the property owner, and photographs
which were all mailed today to the offending neighbor and copied to you and to the Village Attorney, putting
him on notice of this unlawful situation and directing him to make all corrections. The offending party has
thirty(30)days to comply.
I would recommend that you to consult with your HOA attorney in this matter and take whatever action is
necessary on your part to protect your interests and those of the Hidden Falls HOA.

Dear Mr. & Mrs. Charney:
We represent the Board of Directors of Hidden Falls at Rye
Brook Homeowners Association, Inc. (the "Association") . The
Association was recently informed by the Village of Rye Brook
that you have trespassed upon the Association' s property and
constructed multiple detached buildings and installed a fence and
pool thereon. Please be advised that the Association intends to
take all necessary steps to hold you liable for your unauthorized
and unlawful acts.
We are further informed that the Village of Rye Brook has
served a Notice Of Violation and Order to Remedy Same on you, a
copy of which is enclosed. We understand that you have been
directed to cure all violations no later than June 24, 2022.
Please be advised that the entry onto Association property
by you or your agents is prohibited and will be considered a
further trespass until such time that we confirm your compliance
with the following conditions:

It has come to the attention of the Building Department that multiple construction initiatives have taken
place without permits and in violation of Village & NY State Codes on your property and on property
annexed and being utilized by you,but owned by the Hidden Falls Homeowners Association.your adjacent
neighbor.
Attached hereto are photographs of your property and of property owned by the Hidden Falls HOA provided
to our office by the Office of the Tax Assessor showing multiple structures under your control and intended
for your use for which no permits exist.These non-permitted illegal structures include but are not limited
to a circular fenced-in area resembling an above-ground swimming pool on Hidden Falls HOA property,at
least eight (8) detached accessory buildings, two (2) of which are on Hidden Falls HOA property, and
privacy fencing installed on Hidden Falls HOA property,to name a few.
By way of this letter and attached Notice of Violation #E 1404 you are hereby directed to immediately
demolish and/or remove all illegal structures& materials/debris from the Hidden Falls HOA property and
to schedule an inspection of the property with the Building Department to confirm compliance. You are
further directed to file for permits to either demolish/remove all the unlawful structures from your property,
or file to legalize them, if possible,in the manner prescribed by law.
Be advised that failure to comply with this notice by no later than June 24,2022,which is thirty(30)days
