On behalf of the Rye Brook Building Department please allow me to express our most sincere condolences to you and to the entire Cirioni family on the passing of your Father. We are committed to assisting you in resolving these matters as quickly as possible. There are two main issues at hand regarding the rear dwelling: 1. There is no Certificate of Occupancy for a 2-family use. 2. There is no permit to finish the grd floor. Fortunately, both issues can be resolved together in accordance with Village Code §250-25.M.(2), which sets the criteria for a 2-family conversion. That code section is provided below: 4- 250-25.M.(2) -70 6 R Any dwelling existing at the time of the adoption of this chapter may be converted for use by more than one family, provided that all of the following standards are met and maintained: Floor space, exclusive of basement and attic areas but including hallways, must equal a minimum of 750 square feet per family to be housed. (b) No changes are made in the exterior appearance of the building except for any required fire escapes. Service access from the rear yard of the building is provided for each apartment. - (d),The required off-street parking spaces are provided as specified in Article IV, § 250- 6GO), and no tenant of the dwelling is prohibited from utilizing the off-street parking by the landlord or any agent thereof. (5 spaces required) The required usable open space is provided as specified in Subsection J. [as required by Article IV, §250-6.B.(3)] (1,200 sq. ft. per dwelling unit for a total of2,400 sq. ft. having a minimum dimension of not less than 20') You must file an Interior Building Permit Application to legalize the 2-family use and the finished 3rd floor. The application must be accompanied by complete dimensioned floor plans of all floors of the entire dwelling including the basement and attached former garage, which perhaps should be identified on the plans as a storage shed since it cannot be used to garage an automobile in its current state of disrepair. The plans must show compliance with all five (5) of the above captioned code requirements, or information indicating that you intend to seek relief from the Zoning Board of Appeals for any specific item. Your file already contains a site plan prepared by Ms. Jucaite which she may wish to modify to satisfy the parking requirements. Following the application review and approval process you will need to retain the services of a Westchester County Licensed Electrician and Plumber, along with an HVAC contractor to file for their respective 1 •mechanical permits for the work that was done to facilitate the conversion. Any newly proposed construction or work required for code compliance must be done by a Westchester County Licensed Contractor and their license and insurance information must be provided to the Building Department for review prior to the issuance of a permit. In every case, a permit is required prior to performing any work. Upon completion of all work, successful completion of all required inspections, and payment of all fees, we will then be able to provide a Certificate of Occupancy legalizing the 2—family use, finished 3Td floor, and exterior site modifications. I have attached a copy of the Interior Building Permit Application hereto for your convenience. At last night's meeting the Zoning Board of Appeals adjourned your variance hearing until the February 1st agenda should you be able to make the application deadline. However, the Board is amenable to adjourning it to the March 1st or April 5th meeting should you require additional time to prepare your application materials and plans.
