The application is #22-006 and the Notice is dated January 11, 2022. While we anticipate that we are appealing for a variance to be granted by the Board, we also would ask the Board members to consider the interpretation of the code section in question. The subject property is located in the Scenic Roads Overlay District. One of the requirements of this district is that a 35 foot wide area, measured backwards from the front property line, shall be maintained by the homeowner as a "vegetative buffer." Section 250-7.F.(6)(c) posits this more as a maintenance requirement than as one that impacts construction. More precisely, this is not defined as a construction "setback" requirement, which are separate from this "buffer" requirement. Instead, our interpretation of this section is that it is meant to encourage the maintenance of existing vegetation and natural features. No trees are being removed as part of this project and, while a portion of the original front lawn in this area has been removed, it will be restored as a part of this project. The "vegetative buffer" code section also notes that existing "stone walls or other architectural features" within the vegetative buffer should be "preserved." It is contradictory to us that existing stone walls are encouraged but that new stone walls are not permitted. Consequently, we feel that this is a misinterpretation of this code section. We hope that you will take the above into account when we are able to appear before the Board in person. That being said, we are aware that you may conclude that the building inspector's interpretation of the code is fair and that we are still required to appeal to you for a variance. In light of that possibility, we would like to add that the work being legalized within the buffer is minimal and that being a natural stone wall, it fits with the character of the existing surroundings (refer also to section 250-7.F.(6)(a)). Landscape walls are normally permitted in front yards per Section 250-6.B.(1)(g) with a maximum height of 4 feet. The actual height of the wall we propose is only approximately 2.5 feet. Lastly, we do not believe that the work will have any impact on the surrounding homes.
