CODE: SECTION&TITLE: Village of Rye Brook §250-9.A. Building Permit Required DESCRIPTION: Multiple detached accessory buildings constructed/installed without permits. CODE: SECTION&TITLE: Village of Rye Brook §250-6.B. (1) (g) [2] Fence Permit Required DESCRIPTION: Privacy fencing installed without a permit . You are hereby directed to contact this department, obtain all necessary permits & commence to correct the above captioned violation(s) immediately. Violations of the NYSUFP&BC must be completely cured by no later than, June 24, 2022 , which is thirty (30) days after the date of this notice and are returnable at the rate of $1,000.00/day for each day of continued violation, or imprisonment not exceeding one year, or both. Note that a re-inspection of the premises is required by law to confirm compliance with this notice & all other applicable codes. Morlino May 24,2022 Jeffrey&Ilse Charney Via Certified Mail 5 Wilton Circle Rye Brook,NY 10573 Re: Illegal Construction—Notice of Violation#E 1404 Dear Mr.& Ms. Charney, It has come to the attention of the Building Department that multiple construction initiatives have taken place without permits and in violation of Village & NY State Codes on your property and on property annexed and being utilized by you,but owned by the Hidden Falls Homeowners Association,your adjacent neighbor. Attached hereto are photographs of your property and of property owned by the Hidden Falls HOA provided to our office by the Office of the Tax Assessor showing multiple structures under your control and intended for your use for which no permits exist. These non-permitted illegal structures include but are not limited to a circular fenced-in area resembling an above-ground swimming pool on Hidden Falls HOA property,at least eight (8) detached accessory buildings, two (2) of which are on Hidden Falls HOA property, and privacy fencing installed on Hidden Falls HOA property,to name a few. By way of this letter and attached Notice of Violation #E 1404 you are hereby directed to immediately demolish and/or remove all illegal structures& materials/debris from the Hidden Falls HOA property and to schedule an inspection of the property with the Building Department to confirm compliance. You are further directed to file for permits to either demolish/remove all the unlawful structures from your property, or file to legalize them, if possible, in the manner prescribed by law.
