Even though I attempted to explain this to all parties I do not believe anyone has grasped the issue at hand or the likely potential for a non-favorable outcome for the homeowners should they proceed with an application to keep the retaining wall. Mr. Servedio disturbed a protected steep slope when he built the retaining wall in question and patio without a permit or any Board review or approvals in violation of Village Code. The retaining wall in question is in the steep slope,but the patio is not.Village Code requires a Site Plan Application before the Planning Board for a Steep Slopes Work Permit to legalize the work performed within the Steep Slope.That's why in April the ARB told him to remove the retaining wall from the steep slope and they'd approve the patio. They made a compromise to assist the homeowners to avoid the Planning Board process and not demolish everything they built illegally,just the retaining wall in the protected steep slope. Now Mr. &Ms. Servedio have decided that they'd rather not remove the wall and think they can simply return to the ARB for an amendment. Obviously, the property owners are free to proceed however they want, but in my professional opinion as one with over twenty years of experience as the Village Building Inspector, I believe the ARB would be amenable to a proposed redesign of the patio of the same or similar size, however any attempt to keep the wall will not be well received. Furthermore, before they can even appear before the ARB, they must file a Site Plan Application to appear before the Planning Board for approval of a Steep Slopes Work Permit.The site plan process is expensive,and a minimum two-month process for review with no guarantee of a favorable outcome. In my professional opinion they should abandon any idea of keeping the retaining wall in question and proceed with full restoration of the slope. Please share this information with the homeowners and if they still want to proceed, I'll be happy to provide whatever assistance you require to get them before the Planning Board. I've attached a copy of the Site Plan Application hereto for your convenience which also contains the Steep Slopes Code section.
