I took several photos, 4 of which are attached hereto for your review. After review of all available information and upon examination of the property and the wall in question, I offer the following observations: The wood tie retaining wall has failed and is now in an advanced state of disrepair. The slope at the rear yard of 32 Bonwit Road is severely eroded and has been filled in with grass clippings, dead tree branches, and un- stabilized general green waste. The dead-man outriggers which extend from the wall into the rear yard slope at 32 Bonwit intended to prevent the wall from migrating to the south have failed allowing the wall to migrate such that the wall is now being supported almost exclusively by a large mature tree on Talcott Woods HOA property; see photo 1. Photos 2, 3, and 4 indicate that at some point in the past the wall at 32 Bonwit was nailed or otherwise fastened to the wall at 34 Bonwit. Clearly that connection has since failed. Based on my observations and review of all available information, and upon consultation with Mr. Nowak I have determined that the wall in question is under the control of the property owner(s) of 32 Bonwit Road as it serves to stabilize the slope of that property. Furthermore, given the advanced state of disrepair of the slope and of the wall, I intend to condemn the wall in question. I further intend to compel the property owner(s) of 32 Bonwit Road to apply for a permit to demolish the wall, re-establish a stabilized slope, and construct a new retaining wall on the subject property as required by Village Code.
