Per our onsite visit late April 2021, we reviewed these trees and discussed their condition As a result of the site Visit, a Violation is being issued as per the code sections listed below: 235-8 Trees on private improved properties. On private improved properties: A. No person or firm shall,without a Tree Removal Permit,purposefully,carelessly or negligently cut down or otherwise destroy any tree which has a DBH of 10 inches or greater. E. No person or firm shall purposefully,carelessly or negligently clear cut, improperly prune,or cause injury to any tree which has a DBH of 10 inches or greater. 235-12Tree Topping, A. It shall be unlawful to engage in the Topping of any street tree or other tree on public and private properties.Trees severely damaged by storms or other causes and trees under utility wires or other obstructions where other pruning practices are impractical may be exempted from this chapter at the determination of the Approving Authority. In order to remedy the violation the Village Code provides as follows: §235-24-A. Penalties for offenses: "In the event of a violation, the approving authority shall have the authority to propose suitable mitigation in connection with said violation based on formulas listed below, prior to an appearance ticket being issued. if the violator does not agree to proposed mitigation, the approving authority shall request the court to require such and additional measures. Mitigation by the approving authority shall be based on the following formulas: (DBH x 0.475) or[(Widest portion of remaining stump)x 0.475J. Page 1 of 2 The field measurement of the trees are approximately 20", 20", 24"28", 16", 20"26" in diameter totaling 154 caliper inches. Replacement caliper in inches is as follows: 154"x 0.475= 73.15" replacement inches. Therefore, the number of trees to be replanted would be(73"12.5"caliper replacement)=29 trees. The Approval Authority is offering one of the following options (circle one option): 1.) Replant(29)2"caliper hardwood trees such as maples,oaks, elms, etc.(Ornamentals not allowed such as purple plum,cherries,Japanese maples, pears, etc) 2.) Replant(10)2"trees and pay a remaining replanting fee of$4,750(19 remaining trees to be planted X$250)(replanted trees shall be inspected and maintained for minimum 2 years). 3.) Pay replanting fee of$7,260(29 remaining trees to be planted X$250) §235-18 Restoration requires the following action to be taken be taken regarding the existing stumps: §235-18-G. The tree trunk, limbs, stump and any roots remaining above grade shall be removed completely to a depth of six inches to eight inches below grade. §235-18-H. The disturbed area shall be backfilled, replanted and/or reseeded. Additionally, the Village Code provides as follows: §235-18-D Restoration : "All trees that fail to survive as a result of the restoration work required under this section for a period of two calendar years following planting shall be replaced by the owner of the land. Said replacement shall be within 60 days following written demand from the Village for such replacement, or within an extended period of time as may be specified. Tree topping is expensive, mutilating and obsolete. Yet it still occurs widely throughout the Midwest. Why is it bad? Myth and lack of public understanding about proper tree care are two major reasons why people pay to have their trees destroyed each year. What is Tree Topping? Tree topping is the drastic removal,or cutting back,of large branches in mature trees, leaving large, open wounds which subject the tree to disease and decay.Topping causes immediate injury to the tree and ultimately results in early failure or death of the tree. Other names for this malpractice include stubbing, heading, heading-back,stubbing-off,tipping hatracking,topping off, dehorning, lopping, or roundover. In short,topping-by any name-is the worst thing to do to the health of a tree. Tree Topping vs.Tree Pruning: No Contest Tree topping should never be confused with proper pruning. A topped tree is easy to spot-the tree's natural shape has been destroyed, while a properly pruned tree often looks as if no work has been done at all. With proper pruning, an arborist will spend time carefully selecting and removing branches. Careful selective pruning retains the tree's natural shape and beauty. Proper pruning is an important part of caring for- and protecting-the health of your trees. Yet, despite more than 25 years of literature and seminars explaining its harmful effects, topping remains a common practice. If a tree does not have the stored energy reserves to do this, it l will be seriously weakened and may die. When the leaves are removed, the remaining branches and trunk are suddenly exposed to high levels of light and heat. The result may be sunburn of the tissues beneath the bark. The irony is that while the goal was to reduce the tree's height to make it safer, it has been made more hazardous than before. Topping Makes Trees Ugly i The natural branching structure of a tree is a biological wonder. Trees form a variety of shapes and growth habits, all with the same goal of 3 _ presenting their leaves to the sun. Topping removes the ends of the I 0 branches, often leaving ugly stubs. Topping destroys the natural form of a tree. Without the leaves (up to 6 months of the year in temperate climates) a topped tree appears disfigured and mutilated. With the leaves, it is a a t' dense ball of foliage, lacking its simple grace. A tree that has been topped can never fully regain its natural form. Tres that have been topped may become hazardous and are unsightly. Topping is Expensive The cost of topping a tree is not limited to what the perpetrator is paid. If the tree survives, it will require pruning again within a few years. It will either need to be reduced again or storm damage will have to be cleaned up. If the tree dies, it will have to be removed. Topping is a high maintenance pruning practice, and there are some - -- hidden costs of topping. One is the reduction in property value. Since topping is considered to be an unacceptable pruning practice, any damage caused by branch failure of a topped tree may lead to a finding of negligence in a court of law. • Alternatives to Topping There are times when a tree must be reduced in height or spread. Providing clearance for utility lines is an example. There are recommended techniques for doing this. If practical, branches should be removed back to their point of origin. If a branch must be shortened, it should be cut back to a lateral that is large enough to assume the terminal role. A rule of thumb for this is to cut back to a lateral that is at least 1/3 the diameter of the limb being removed. This method of branch reduction helps to preserve the natural form of the tree. However, if large cuts are involved, the tree may not be able to close over and compartmentalize the wounds. Sometimes the best solution is to remove the tree and replace it with a species that is more appropriate for the site. Hiring an Arborist Pruning large trees can be dangerous. If pruning involves working above the ground or using power equipment, it is best to hire a professional arborist. Topping Can Lead To Unacceptable Risk The survival mechanism that causes a tree to produce multiple shoots below each topping cut comes at great expense to the tree. These shoots develop from buds near the surface of the old branches. Unlike normal branches that develop in a socket of overlapping wood tissues, these new shoots are anchored only in the outermost layers of the parent branches and are weakly attached. New shoots grow quickly, as much as 20 feet in one year. Alternatives To Topping Sometimes a tree must be reduced in height or spread, such as for prevailing utility clearance. There are recommended techniques for doing do. Small branches should be removed back to their point of origin. If a larger limb must be shortened, it should be pruned back to a lateral branch that is large enough to assume the terminal role. This method of branch reduction helps preserve the natural form of the tree. Sometimes the best solution is to remove the tree and replace with a species that is more appropriate for the site.
