You will recall that in 2016 this Board granted Amended Site Plan approval to permit the erection of a seasonal tent on the Property, together with fencing, landscaping, and associated site improvements. The Board's approvals states, This Amended Site Plan approval applicable to the tent structure shall be valid until December 1, 2019, unless otherwise extended by the Planning Board for additional three (3) year periods upon written request of the Applicant provided the Applicant demonstrates substantial compliance with all conditions of this resolution. In accordance with the approval resolution, a copy of which is enclosed herewith as Exhibit A, the Applicant hereby requests such a three-year extension. As required by the resolution, each of the conditions of approval has been substantially complied with, as follows: 1. The Site Plan shall be revised as follows: a. The plan set shall be revised to remove the sheet entitled "Conceptual Site Plan Option 2" because "Conceptual Site Plan Option 1 " is the approved alternative. b. A note shall be added stating that the path lighting will be triggered by a push bar installed in the gate shown on the plan and that such safety lighting shall be maintained in good working order at all times. c. The path located in Surface Slope Data, Sheet SS-1, shall be shown on the Site Plan. The final Site Plan was amended as required. A copy of the Site Plan, incorporating the foregoing notes, is enclosed herewith as Exhibit B. 2. All comments in the October 12, 2016 memorandum of the Emergency Services Task Force and any subsequent ESTF memorandums shall be addressed to the satisfaction of the ESTF prior to the issuance of a Temporary Tent Permit. All ESTF comments were addressed, and Tent Permits were properly issued for the temporary tent. 3. Detail sheets shall be provided for the paved emergency access path construction, installation of bollard lighting and the grading plans for such paths, to the satisfaction of the Village Planning Consultant, Village Building Inspector and Village Engineer/Superintendent Public Works. All required detail sheets were provided to Village staff as required. 4. The tent shall only be used and occupied between April 1 and December I for a maximum of 180 days. The 180-day time period shall commence upon the issuance of the final Inspection Report from the Building Department authorizing occupancy of the temporary tent. A temporary tent permit shall be sought by the Applicant each year the tent is proposed to be constructed. To minimize impacts resulting from construction and deconstruction of the tent, the tent shall be constructed and deconstructed only once per year. Construction of the tent may occur prior to April 1 but no sooner than March 1, but deconstruction of the tent shall occur prior to December 1. All construction and deconstruction of the tent will occur within the time periods set forth in the Village of Rye Brook Noise Ordinance (Chapter 158 of the Village Code), except that no construction or deconstruction shall be permitted on Saturdays and Sundays. The Applicant only permitted the tent to be used and occupied between April 1 and December 1, and not for more than 180 days in a year. All construction and deconstruction of the tent occurred within the time periods set forth in the Village of Rye Brook Noise Ordinance, and did not occur on Saturdays or Sundays. All deconstruction work was completed prior to December 1. The tent was only erected and taken down once per year. 5. Patron use of the tent is limited to the following hours: Start: 7:00 a.m. —Monday to Friday 9:00 a.m. —Saturday and Sunday 2 Stop: 9:30 p.m. —Sunday to Thursday 11:00 p.m. —Friday and Saturday Staff set-up and breakdown within the tent shall occur no sooner than one (1) hour before and after patron use. The Applicant does not permit patron use of the tent beyond the hours listed herein. To the best of the Applicant's knowledge, patron use of the tent has been limited by hotel staff to the approved hours, and staff set-up and breakdown within the tent have not exceeded the hours outlined. 6. Use of the tent shall be limited to a single group occupying at least 65 rooms of the hotel, shall comply with all conditions set forth in this resolution and all applicable laws, rules and regulations, and shall be limited to the following activities: meetings, ceremonies, exhibits, religious functions, meals, and social gatherings, such as a cocktail reception, wedding meal or networking event. All tent reservations were made by single groups, who were required to reserve at least 65 rooms. The tent was not permitted to be rented for any use other than meetings, ceremonies, exhibits, religious functions, meals, and social gatherings such as cocktail receptions, wedding meals, or networking events. 7. Valet parking shall implemented by the Applicant while the tent is in use for an event. Valet parking was implemented while the tent was in use. 8. All proposed plantings shown on the Landscape Plan shall be maintained in a vigorous growing condition and shall be replaced as necessary to maintain vegetative visual screening between the hotel operation and the adjacent residences. If, after the initial two (2) years, vegetation cannot survive, despite Applicant's best efforts to maintain said vegetation, the Applicant shall install alternative plant species that achieve the same or substantially similar visual screening. Such alternative species shall be reviewed and approved by the Village Planning Consultant. If it is determined at that time by the Village Planning Consultant that non-vegetative screening is necessary due to survivability concerns, the Applicant shall not be required to install further plantings, but must obtain approval from the Building Inspector for the installation of a fence in the same location as the approved plantings for the purpose of visual screening. Such fence permit application shall be referred by the Building Inspector to the Planning Board for comment prior to the issuance of such permit. No public hearing shall be required for the Planning Boards advisory review of the fence permit application. Plantings were installed in accordance with the Site Plan approval, and the planted vegetation has been maintained by the Applicant as required. 9. All applicable requirements of the New York State Uniform Fire Protection and Building Code must be adhered to at all times. 3 To the best of the Applicant's knowledge, all such Code provisions have been adhered to. 10. The cooking of food is prohibited in or adjacent to the tent. The Applicant has not permitted the cooking of food in or adjacent to the tent. To the best of the Applicant's knowledge, no such cooking has occurred while the tent is in place. 11. Staff setup and breakdown of plates, dishes, silverware, glasses and other food service items shall take place inside the tent and its bussing marquee. The Applicant has required staff to conduct all breakdown and cleaning activities within the tent and its bussing marquee. To the best of the Applicant's knowledge, no such activities have occurred outside. 12. No open flames of any kind are permitted, including sterno fuel. The Applicant does not permit open flames within the temporary tent. To the best of the Applicant's knowledge, no such flames have occurred within the tent. 13. No smoking is permitted in or adjacent to the tent. Smoking shall be limited to existing designated smoking areas on the property. The Applicant does not permit smoking in the tent. Staff is under instruction to move all smokers to designated smoking areas. To the best of the Applicant's knowledge, no smoking has occurred within the tent. 14.Air conditioning units shall be turned off no later than 10:00 p.m. Sunday to Thursday, no later than H:00 p.m. Friday and Saturday, and shall not be operated when the tent is not in use. The units shall not be turned on earlier than 6:30 a.m. Monday to Friday, 8:30 a.m. Saturday and Sunday, or 30 minutes prior to patron use of the tent, whichever is later. The Applicant has instituted a policy that air conditioning units may not turned on earlier than the prescribed times, or later than the prescribed times noted above. To the best of the Applicant's knowledge, these time constraints have been complied with, and the units have not been operated when the tent is not in use. 15. No music shall be played outside of the tent. No music shall be played in the tent later than 9:00 p.m. on Sunday through Thursday, and no later than 10:00 p.m. on Friday and Saturday. All amplifiers/speakers shall be directed away from the residential properties. Disc jockeys and live bands are prohibited in and around the tent. However, a harpist, acoustical guitar, string quartet or other similar acoustical music is permitted provided the Applicant shall comply with the Village of Rye Brook Noise Ordinance (Chapter 158 of the Village Code) and all other laws, rules and regulations in the operation of the tent. Within the first two weeks,following the issuance of the Final Inspection Report by the Building Department approving the temporary tent for occupancy, the Applicant shall .submit an 4 acoustic analysis performed by a NYS licensed acoustic engineer to measure noise levels at the rear property line. The protocol and methodology for such analysis shall be subject to approval by the Village's consulting acoustical engineer. The costs of the Village's review of such acoustic analysis shall be borne by the Applicant. Music is not permitted by the Applicant outside of the tent, and is not permitted by the Applicant inside the tent beyond those hours listed herein. To the best of the Applicant's knowledge, all amplifiers/speakers in the tent have been directed away from the residential properties, and there have been no violations of the Village of Rye Brook Noise Ordinance or other laws,rules and regulations in the operation of the tent. An acoustic analysis was performed by a licensed engineer, using the methodology prescribed by the Village, at the Applicant's sole expense. This analysis found that tent operation does not considerably impact noise to the surrounding residential properties. 16. The tent may only be used by a patron or group that has also reserved an indoor event space at the hotel, such as a banquet hall or meeting room. All tent reservations also require the reservation of an indoor event space at the hotel. 17. No exterior lighting is permitted beyond what is necessary for safety purposes. The Applicant has limited the use of associated exterior lighting to that which is necessary for safety purposes. 18. The Applicant has agreed that it shall provide 24-hour contact information to the owners of the residential properties abutting the area of the temporary tent and shall use best efforts to respond to all good faith neighbor communications regarding the operation of the tent within a reasonable amount of time of receiving the communication, but in no case greater than five (5) business days, provided that such neighbor communication reasonable relates to tent activity. Business days shall be considered Monday through Friday, not including holidays. The Applicant shall not be required to respond to questions or comments that have already been substantively answered. The Village Planning Board, Building Inspector and Administrator shall be copied on all communications between the Hilton and residents. In addition, the Applicant agrees to make an executive member of its management staff available to meet with interested residential neighbors to discuss any concerns resulting from the operation of the tent pursuant to the following meeting schedule: (1) the Applicant shall schedule a meeting to be held no later than three weeks after the issuance of the Final Inspection Report by the Building Department approving the temporary tent for occupancy each year, (2) a second meeting shall be held no later than 10 weeks after the first meeting, and (3) additional meetings shall be scheduled by the required to meet with the neighbors more than three times while the tent is operational. The Applicant shall send written notice to the aforementioned abutting residential property owners of the date and time [ofj such meeting no later than two weeks prior to such meeting. The Village Administrator shall also be provided at least two week's written notice of the time and place of such meetings, so that a Village official, the Village Planning Board Chair, Village staff member, or designee will 5 have an opportunity to attend In the event the Applicant fails to timely schedule one or more of the meetings described herein, the Planning Board Chair may make a written request to the Applicant to schedule such meeting within 30 days of such request. The Applicant provided 24-hour contact information to the owners of the abutting residential properties. The Applicant has acted in good faith to respond to all reasonable neighbor comments relating to the tent within five (5) business days. The Village has been copied on all such communications. The Applicant has also designated a member of its management staff to be available to interested residential neighbors in accordance with the foregoing schedule. The Applicant has sent written notice to the applicable property owners of the date and time of such meetings at least two weeks in advance, with a copy provided to the Village Administrator. Copies of the required notices are attached hereto as Exhibit C. 19.A copy of this Resolution shall be attached to Temporary Tent Permit and the Final Inspection Report by the Building Department approving the temporary tent for occupancy. At the discretion of the Building Inspector, failure to comply with the conditions set forth herein shall constitute the basis for denial or revocation of a Temporary Tent Permit, Final Inspection Report by the Building Department approving the temporary tent for occupancy or other similar authorization issued by the Village Building Department concerning the temporary tent. Upon written notice of a violation, the Applicant shall be given a period of five (S) days to cure the violation, unless such other period of time is determined by the Building Inspector in his sole discretion. The Planning Board shall have continuing jurisdiction with respect to this Amended Site Plan approval upon referral by the Building Inspector, at his sole discretion, and upon a finding by the Planning Board that a material condition of this Amended Site Plan approval has been violated, the Planning Board may, following a duly noticed public hearing, terminate such approval or attach such additional reasonable conditions as may be necessary for the protection of health, safety and welfare of the community. A copy of the approval resolution has been attached to all Temporary Tent Permits and the Final Inspection Reports for the tent. We have also included a check for the required escrow amount. Kindly place this matter on the agenda for the July 11, 2019 Planning Board meeting, at which we respectfully request the Board grant the requested extension. In addition, the Applicant agrees that it shall make an executive member of its management staff available to meet with interested residential neighbors to discuss any concerns resulting from the operation of the tent pursuant to the following meeting schedule: (1) the Applicant shall schedule a meeting to be held no later than three weeks after the issuance of the Final Inspection Report by the Building Department approving the temporary tent for occupancy each year, (2) a second meeting shall be held no later than 10 weeks after the first meeting, and (3) additional meetings shall be scheduled by the Applicant upon request of the neighbors, as necessary, but the Applicant shall not be required to meet with the neighbors more than three times while the tent is operational. The Applicant shall send written notice to the aforementioned abutting residential property owners of the date and time such meeting no later than two weeks prior to such meeting. The Village Administrator shall also be provided at least two week's written notice of the time and place of such meetings, so that a Village official, the Village Planning Board Chair, Village staff member, or designee will have an opportunity to attend. In the event the Applicant fails to timely schedule one or more of the meetings described herein, the Planning Board Chair may make a written request to the Applicant to schedule such meeting within 30 days of such request. 19. A copy of this Resolution shall be attached to the Temporary Tent Permit and the Final Inspection Report by the Building Department approving the temporary tent for occupancy. At the discretion of the Building Inspector, failure to comply with the conditions set forth herein shall constitute the basis for denial or revocation of a Temporary Tent Permit, Final Inspection Report by the Building Department approving the temporary tent for occupancy or other similar authorization issued by the Village Building Department concerning the temporary tent.
