Facsimile to;(914)468-7330 10 Rye Ridge Plaza, Suite 200 Rye Brook,NY 10573 Dear Mr. Stahl, The Building Department is in receipt of your letter dated 10/1/07,a copy of which is attached,requesting permission to conduct paving operations at the shopping center parking lots after the normal hours of operations for construction activity as specified in §158-4 of the Code of the Village of Rye Brook. As discussed in our meeting with Village Administrator Christopher J. Bradbury on 10/17/07,permission is hereby granted to you to perform paving operations on the parking lots of the shopping center during night-time hours as per§158-5.A. of the Code of the Village of Rye Brook with the following conditions: 1. This permission does not apply to the parking lot areas adjacent to the homes located on Roanoke and Westview Avenues. 2. There is to be no playing of radios at any time except for personal listening devices. 3. There is to be no loud or inappropriate language used by anyone at any time. 4. Every effort shall be made on your part and on that of the contractor to keep necessary noise levels down to a minimum,and eliminate any unnecessary noise. 5. This permission can be revoked by the Building Department at any time and for any reason. 6. This permission shall expire upon completion of the paving activity. 7. A copy of this letter shall be kept on the site at all times and shall be made available for review upon demand by any bonafide Village Official. Despite our tenants and customers' patience wearing thin, now that the center lots are starting to look slightly more finished the excitement is building. During one of our planning meetings it was suggested that the final finish asphalt coat and striping could be finished faster, and more safely if performed at night. Once again I am writing to request a waiver of the night work ordinances. Specifically we would like to pave and stripe between the hours of 11 pm and 6am for five nights. We are uncertain at this point regarding when we would start the final paving, but estimate the start date during the week of October 22, or October 29. We are planning on overlaying the main shopping center lot and the final finish coat of the center lot in one phase, over the course of five working days. On the whole we believe it is safer to do this paving at night since number of parking spaces available during the days would be increased, thereby easing traffic congestion and possible traffic accidents. Also we are trying to be sensitive to our tenant's main complaint that reduced parking severely impacts their ability to make sales. Even if spaces are available somewhere in the center, if the parking is too far away too many people will simply drive on. We are also concerned about the number of 40 ton asphalt trucks that will be coming into the area during working hours and their ability to stop quickly when faced with a customer looking for parking spot, or middle school child not watching where they are going either before or after school. The most sensitive area is where our property abuts residential homes on Westview Ave. We will not need more than two nights in this immediate area to complete our work. While we recognize that it will not impact your decision making, in order to be good neighbors, if approved we plan on offering the three immediate neighbors on Westview Ave. accommodations at a local hotel for the nights we are immediately behind their homes.
