Dear Mr. Izzo:
We are preparing to remove some of the remaining canopies. In accordance with State
requirements we tested the canopies for environmental concerns, which yielded positive
results in certain areas of both canopies for asbestos containing materials, a `controlled
substance' as determined and regulated by the State of New York.
We have contracted Asbestos Corporation of America(ACA)to perform the removal,
and Airtek Environmental Corp.,to perform the required independent air monitoring
during the abatement. ACA filed the required documents with New York State,the
governing agency, and has allowed the mandated waiting period to lapse prior to
commencing their work. It is my understanding that all required filings with any
governmental agency necessary to perform this work are complete.
Recognizing that the Village of Rye Brook has regulations with respect to work hours,
we are requesting that the Building Department permit the abatement work to be
performed during night hours, when stores are closed and pedestrian traffic is practically
non-existent. As I am sure you are aware,this type of work is usually performed in the
off hours when it cannot be isolated from such a public arena as an open air shopping
center.
Several of the areas being abated are directly over tenant doorways. Performing the work
at night also minimizes interruption to the existing tenants. If this work must be
performed during the minimal hours permitted by the Village, the safe practices and
procedures ACA follows in accordance with NYS guidelines,would increase the removal
process' time requirements, and would substantially interfere with existing businesses
and the community's ability to access the services offered in the shopping center. I
suspect many of the tenants would elect to close, something neither of us would want to
happen.

The work is expected to take 2-3 days on the shopping center's lower level canopy, and
approximately seven days for the shopping center's main level, on the assumption we
work during night hours. Neither of these areas is directly adjacent to a residential
neighborhood, and the work is not loud, which is my understanding for the restrictions
established by the Village for hours of work.
To better inform you in your decision making you are being provided the following
documentation which you requested:
• ACA's license to perform the abatement
• The job supervisor's license
• Certificates of Insurance
• Safety Data sheets, Materials and Equipment listings
• Waste handling and landfill information
• ACA's respiratory practices and procedures program
• Notice of NYS filings
We anticipate that the Village will agree that abatement of a controlled substance is best
performed at night since it minimizes the general public and our tenant's exposure to
materials as they are being removed, and allows for a faster and safer abatement program.
We are scheduling night time removal to resume on Friday July 13 unless you advise us
to the contrary. If permission is granted we would appreciate your informing the Village
Police Department so that no additional warnings or tickets are issued. No date has been
set yet to start work on the main level canopy, and we will inform you when we expect to
start that work.
Finally we are requesting a temporary exception from the hours of operations ordinance
of construction equipment, and grant us permission to start site work at 6:30 AM.
Commencing work earlier allows the contractor to move heavy equipment and materials,
barricades and other traffic control items into place before high volumes of vehicle and
pedestrian traffic arrives on site. Moving equipment earlier in the morning reduces the
likelihood of unsafe conditions. I hope your department will be willing to assist us in this
manner. Safety is always our number one priority.
