The new wall would be required to comply with the requirements of Section 250-6 B,(1)(g) of the Village Code regarding residential retaining walls. The grading and disturbance of the backyard slopes would be required to comply with the requirements of the Village Code regarding steep slopes. During construction, every effort should be made to minimize disturbance of the remaining vegetation and slopes in the rear yard of the lot. • We recommend that the site plan be reviewed to ensure that the proposal causes the least amount of disturbance practicable to regulated slopes and creates the least amount of retaining walls necessary on the site. • It is difficult to see the sizes of some of the trees proposed to be removed. Property Description The 15,000 square-foot property is currently developed with a one-story residence with a basement garage, driveway and curb cut, a patio in the rear yard, retaining walls, exterior front steps and a walkway. The property slopes down 27 feet from a high point at northern end of the rear property to the southern end of the front property line at Eagles Bluff. Areas of regulated steep slopes are located on the lot. Mature landscape trees and other plantings are located throughout the property. Review We have reviewed application materials and plans that include the following items: 1. Short Environmental Assessment Form and EAF Mapper Summary Report dated 8/14/20; 2. Application for Site Plan Approval; 3. Site Plan Submittal Review Checklist; 4. Exterior Building Permit Application; 5. The following engineering plans generally entitled, "Ham Residence 6 Eagles Bluff' prepared Fusion Engineering, PC, last revised 8/3/20: a. Sheet 1 of 2, "Site Plan," b. Sheet 2 of 2, "Details;" 6. Please note that our review is limited to planning and environmental issues. We offer the following comments regarding the application: 1. SEQRA. The Proposed Action is a Type II action with regard to SEQR because it involves the construction of minor accessory/appurtenant residential structures, including garages, carports, patios, decks, swimming pools, tennis courts, satellite dishes, fences, barns, storage sheds or other buildings not changing land use or density. 2. Landscaping and Screening. Grading and construction of the retaining wall will disturb land area that must be restored and replanted.The plans should be revised to show the restoration of the grass areas. During the sketch plan presentation at the May 2020 Planning Board meeting, the Board questioned if adequate screening would be provided to the property to the west. It was discussed that a cross-section could be prepared to demonstrate that the existing trees to remain will provide adequate screening. The cross-section should be provided for review. 3. Tree Preservation and Protection. All existing trees on the property regulated by Chapter 235 of the Village Code in proximity to the work area should be protected during construction. The Rye Brook tree protection details should be added to the site plan. It also appears that proposed grading will be in close proximity to an existing 16-inch Hickory in the northwestern corner of the property.We question if the grading in this area can be amended to further avoid the area of the tree. The 8-inch Birch tree is not a regulated tree and should be removed from the regulated tree list on the site plan. 4. Tree Replacement. Pending review by the Village Engineer, removal of the seven regulated trees will require installation of seven, new, 2 to 2.5-inch caliper shade trees. The plans note that thirteen Norway Spruce are proposed for the site. The spruce trees are not considered replacement trees. We look forward to discussion with the Board. Sarah L.
