Dear Mr. Berner:
Received a telephone call and made inspection on the
property of Mrs. Sam Menduke - 17 Meadowlark Road, Town of Rye,
concerning problem with neighbor on dry stone retaining wall
continuously falling onto her property.
The neighbor is Mr. Stephen Dances of 15 Meadowlark Road
and according to Mrs. Menduke, he will not cooperate in removing
loose stones or repairing wall to eliminate this condition.
Request an opinion from your office on the Town of Rye's
responsibility or jurisdiction in this matter.
