TO THE HONORABLE ZOYING BOARD OP APPEALS
TOWN OF RYE:
The petition of PRO-RIE HOMES, INC. ,respectfully
shows that it is the owner of the parcel of land situate at the
northwest corner of Hawthorne and Westchester Avenues in the
Town of Rye, New York,which parcel is described on the tax
rolls as Section 1, Block 14, Lot 10 B 2 A; 10 B 2 C; 11 B 2 A;
and 11 B 2 C; and 10 B 2 B. -
That it is the desire of the petitioner to
erect and construct single family dwellings on said property
and asks that your Honorable Board grant a variance to it so
that it may erect said buildings with side yards of not less y

than eight feet on one side and not less than five feet on the
other side.
.� This variance is asked for the reason that
Subdivision A 2 of Section 14 of the Zoning and Building; Code
of the Town of Rye,N.Y . , provides that in residence D District, q

�Vrhich is he district in which the property above described is
located,- the minimum side yard in any case shall be not lees
than twelve feet .

Dear Mr. Quigle:
I am enclosing herewith a petition of
Fro -Rie Homes, Inc. which 1 received today requesting
a variance of Section 14, Subdivision 2 of the Zoning
Ordinances requiring a minimum side yard of twelve
feet for a single residence in a "Residence D" District
to permit the erection of single houses with a minimum
side yard of eight feet on one side and five feet on
the other side on lots situated on the northwesterly
corner of Hawthorne and Westchester Avenues and des-
ignated on the assessment map of the Town of Rye as
Section 1 Block 14, Lots 1OB2A, 1OB2C, 11B2A, 11B2C
and 1OB2B.
The law provides that the Zoning Board
of Appeals fix a time for the hearing and give notice
thereof by publication in an official paper (Port
Chester Daily Item) , of such hearing at least five
days prior to the date thereof and at least five days
before such hearing mail notices thereof to all
interested parties.
For your convenience, I am enclosing
herewith a form of notice to be published in the Daily
Item. As soon as you have fixed a date for the hearing,
if you will insert it in the enclosed form, sign same
and return to me, I will see that the notice is
published in the Daily Item.

members end the date is acceptable to them, but I have been
unable to contact Messrs. Smith and William* However, send
notice of the meeting and we wiil take a chance on their being
able to be present*
