Fews, the complainant herein and duly authorized Code Enforcement Officer of the Village of Rye Brook, NY, do hereby accuse the defendant(s) named above, residing at 10 Talcott Road Rye Brook NY 10573, who is the owner of the property at which the following offences were committed, at, 10 Talcott Road in the Village of Rye Brook. NY on or about the 10th day of July, 2017, at or about 5:30pm o'clock. COUNT ONE: Code of the Village of Rye Brook. §91-2.A. Building Permit Required COUNT TWO: Code of the Village of Rye Brook §113 -6 Electrical Permit Required COUNT THREE: Code of the Village of Rye Brook §180-23. Plumbing Permit Required COUNT FOUR: Code of the Village of Rye Brook §250-10.A. Certificate of Occupancy Required. FACTS APPLICABLE TO ALL ACCOUNTS On Monday July 10, 2017, at 4:25 pm, a call came in from the from the Rye Brook Fire Department ("Fire Depamnent'D requesting that an Inspector from the Rye Brook Building Department assist with their investigation of an electrical system at a property located at 10 Talcott Road (the "Property). The Fire Department informed me that they received a complaint regarding the electrical system from Ms. Tetyana Buynska, a co -occupant of the Property. When I arrived at the Property, Ms. Buyanska allowed me access to the home to inspect. I conducted an investigation of the Property with the 2"' Assistant Fire Chief, and two members of the Rye Brook Fire Department. During my investigation, I observed wiring and fixture installations had been added to the first floor bathroom. I also observed that plumbing work and other renovations were in process in the first floor bathroom, including but not limited to removal of existing plumbing fixtures (Tub, shower, sink, and commode) and preparations for the installation of new fixtures. I further observed electrical ceiling fixtures, wall switches and open wire splices in the basement. I also observed interior renovations and alterations in the basement involving framing of walls, reframing and new sheetrock applications to walls and ceilings. Village of Rye Brook Code § 91-2A requires that Defendant obtain a building permit before performing any of the aforementioned alterations. I reviewed the Village of Rye Brook Building Department records and determined that a building permit had not been issued for the aforementioned work. Village of Rye Brook Codes § 113-6 requires that Defendant obtain a plumbing permit before undertaking the aforementioned plumbing work. I reviewed the Village of Rye Brook Building Department Records and determined a plumbing permit had not been issued for the aforementioned plumbing work. Building Department records and determined that a building permit had not been issued for the aforementioned work. Village of Rye Brook Codes § 180-23 requires that Defendant obtain an electrical permit before undertaking the aforementioned electrical work. I reviewed the Village of Rye Brook Building Department Records and determined that no electrical permit had been issued for the aforementioned electrical work. Village of Rye Brook Code §250-10.A requires that Defendants obtain a certificate of occupancy before using or permitting the use of a structure that has been changed or altered. I reviewed the Village of Rye Brook Building Department records and a certificate of occupancy had not been issued for the aforementioned work. All the above is contrary to the provisions of the statutes in such case made and provided. The above allegations of fact are made by the complainant herein on direct knowledge (and upon information and belief), the source of which being an inspection(s) on July 10"' 2017. Any false statements made herein are punishable as a Class "A" Misdemeanor pursuant to §210.25 of the NY Penal Law. COUNT ONE: Code of the Village of Rye Brook. §214-4, 214-6 Stop Work Orders TO WIT: On Monday July 10, 2017, at 4:25 pm, I received a phone call from the Rye Brook Fire Department ("Fire Department's requesting that an Inspector from the Rye Brook Building Department assist with their investigation of an electrical system at a property located at 10 Talcott Road (the "Property'. The Fire Department informed me that they received a complaint regarding the electrical system from Ms. Tetyana Buynska, defendant's spouse and co -occupant of the Property. When I arrived at the Property, Ms. Buyanska allowed me access to the home to inspect. I conducted an investigation of the Property with the 2nd Assistant Fire Chief and two members of the Fire Department. During my investigation, I observed wiring and fixture installations had been added to the first floor bathroom. I also observed that plumbing work and other renovations were in process in the first floor bathroom, including but not limited to removal of existing plumbing fixtures (Tub, shower, sink, and commode) and the installation of new fixtures. I further observed electrical ceiling fixtures, wall switches and open wire splices in the basement. I also observed interior renovations and alterations in the basement involving opening of walls, reframing and sheetrock. At approximately S:OOpm, I placed a "Stop Work Order" on the front door of the Property. The Stop Work Order was posted in the presence of Ms. Buyanska. The Stop Work Order was in writing on a form prescribed by the Building Department and stated the reasons for the Stop Work Order, the scope of the work affected and the date of issuance. I also signed the Stop Work Order. A copy of the Stop Work Order is annexed hereto as "Exhibit A." I subsequently sent a copy of the Stop Work Order by first class mail. On July 11, 2017, I revisited the Property and saw that the Stop Work Order had been removed from the front door of the Property. At such time I spoke to the above -named defendant who identified himself as the owner of the Property. Defendant informed me that he had removed the Stop Work Order. Pursuant to Village of Rye Brook Code § 214-4 "such stop -work order shall be removed from the premises only by the Building Inspector or his duly authorized designee." Neither I nor Building Inspector Michael Izzo removed the Stop Work Order or authorized defendant to remove the Stop Work Order. All the above is contrary to the provisions of the statutes in such case made and provided. The above allegations of fact are made by the complainant herein on direct knowledge (and upon information and belief], the source of which being an inspection(s) on July 10th 2017.
