In both cases the original permitted coverage and set back was exceeded by construction of a larger than permitted deck and allowed to remain after inspection of the completed deck showed that construction had exceeded the originally permitted size. In specifics,the minimum rear yard setback is 20 feet,the rear yard setback was permitted at 14 feet but constructed at 6.6 feet. It was supposed NOT to have side rails and be less than 6 to 9 inches above grade. This requirement was not conformed to. The maximum allowable deck coverage is 3.5%. THe existing deck was permitted at 2.56% but constructed at 6.58%. The current owners want to retain this excess coverage. The result is to place users of the deck almost in neighbors backyards and make the use of the deck intrusive into the peaceful use by the neighbors of their own properties. We object to the continuing"salami slicing" approach to having their property enhanced and the increased value approved by the Village of Rye Brook while the neighbors properties are adversely affected.
