Third Notice of Incomplete Application
Dear Wendell Buckman,
The New York State Department of Environmental Conservation (Department or DEC)
has reviewed the resubmission materials above referenced project, received on June 8,
2021 and submitted on behalf of the Hidden Falls at Rye Brook HOA. The applicant
proposes to rehabilitate the Rye Brook Estates Dam [ID# 232-4333, Class B], a 140-
foot-long concrete and stone masonry dam on Tributaries of Blind Brook [Water Index
No. LIS 11-9 & P1098B, Class C]. The rehabilitation of the dam will include pouring new
concrete cheek walls along the adjacent banks of the dam to raise the height of the
structural portion and contain flow within the spillway.
Based on our review of the submitted resubmission materials, Department staff have
determined that the application is incomplete. Please submit the following items for the
Department to continue its review:

To continue the processing of this application, please see the attached memo, dated
September 1, 2021 , and provide the requested information. All technical questions
should be addressed to John Smith by phone at (518) 408-0338, or by email at

Your application will remain as incomplete until all information requested is received, as
Uniform Procedures Act (UPA) provisions § 621.6(e) allow. Please provide two hard

1 consider the application to be complete. The below comments, however, must
be resolved before I am ready to recommend issuance of a dam safety permit.

Miscellaneous
1. Please provide a cover letter with each of the below comments and a narrative
response indicating what changes, additional documentation, etc. have been
provided to respond to the comment.
2. Please provide a report, as stamped by an engineer licensed to practice in NYS,
which includes the last version of the documents submitted so far for this permit,
including, but not limited to, the below listed items. The EAP, Engineering
Assessment, Inspection & Maintenance Plan, and Annual Certification do not
need to be resubmitted unless there are changes.

Drawings
3. The updated drawings have not been signed or stamped. Please have the
drawings stamped and signed by an engineer licensed to practice in NYS.
Structural Stability
4. 2011 Stability Analysis, Case 3, Spillway Design Flood Loading Case (SDFLC).
The employed uplift force is the same as the one used in the Normal Loading
Case (NLC) despite the pressures at the heel and toe being higher in the
SDFLC. Please explain why the employed uplift force used in the SDFLF is
conservative in this situation.
5. The force caused by the upstream silt has not been considered in any the
loading cases. Was the presence and extent of silt in the upstream face
confirmed?
6. 2021 Stability Analysis, Case 3, Spillway Design Flood Loading Case (SDFLC).
Please provide the basis for the 4-foot saturated overburden used in this loading
scenario.
7. 2021 Stability Analysis, SDFLC, Sliding Stability, Factor of Safety Formula. The
horizontal downstream tailwater force, which appears to have been calculated as
1 .16, has been placed in the numerator of the formula whereas Equation 4-3 in
USACE EM 1110-2-2200 "Gravity Dam Design" (USACE Manual) requires that
this term be placed in the denominator. Please explain why this deviation from
the USACE Manual is conservative in this situation.
8. You correctly find the location of the resultant force for the Normal Loading
Condition. Please include calculations to prove that the resultant force lands
within the appropriate portion of the dam for the other three cases, as directed in
section 10.7.2 of the NYS Guidelines for Design of Dams.
Hydrologic & Hydraulic
9. The Lag time used within the HEC-HMS model is longer, and less conservative,
when compared to the Lag Time correlated to the provided calculation for time of
concentration. Please explain this apparent contradiction or revise your H&H
models, gravity analysis and Supplement D-1 form.
10.Please provide the spreadsheet file used in the Tailwater Analysis.
