John Scarlato,Architect for the applicants addressed the Board. He started with photographs of the existing house. He explained the project to the Board and stated that the proposed addition will be on the left side of the house.The addition will include a master suite,. den and basement. The existing house has three bedrooms. They will be eliminating one of the bedrooms to enlarge the kitchen, dining and living room spaces. The existing square footage of the 1" floor is 1,216. Chairman Moscato asked if the additional 478.7 square feet requires storm water management. John Scarlato explained that they are removing existing impervious, some walkways, flagstone and a paver patio. Zoning Board of Appeals August 3,2021 Without removing these impervious surfaces,the Applicant's would also require an impervious coverage variance. Michael Izzo, Building Inspector explained that storm water management is required when you add 400 or more square feet. The removal of the impervious and the new addition do not trigger storm water management since they are under 400 square feet. The Board discussed the water runoff from the new addition.John Scarlato stated the existing runoff is going into the ground. He is not sure what type of system they have. Michael Izzo advised the architect to submit that information prior to the issuance of a building permit. Chairman Moscato asked about the existing vegetation between the neighbor and the addition. Possibly adding additional screening and maybe the ARB will address it.He stated his concerns were the stormwater and runoff which the Building Inspector addressed. He is not concerned about the size of the addition. The fact that the impervious is being reduced is helpful. Steven Berger noted that if they wanted to add a second story above this addition it would be concerning.The Board discussed how they would have to come back to the Board either way since they will be over their allowable gross floor area. Chairman Moscato stated the Board received one letter in opposition which referenced the wrong property address and did not indicate the writers address or name. The Board received four letters in support of the application from 15, 20,27 &29B Highview Avenue. The proposed deck complies with the code regarding coverage but encroaches into the rear yard setback. The rear and side yards are adequately screened with trees. The proposed deck is sized appropriately to accommodate the applicants needs for an outdoor living space. Michael Izzo, Building Inspector explained how the application was removed from a previous agenda. During the sale of this house, an open permit for a screened porch was found from 1961. The previous property owner applied for the Certificate of Occupancy to close out the permit and the survey revealed that it required two setback variances. It was later discovered that the screened porch sometime between when it was constructed in 1961 and when we received the application, the porch was subsequently enclosed and conditioned. They couldn't proceed with an application to legalize a screened porch because it was no longer a screened porch. The previous owners had to retain a licensed architect to draw plans and apply to legalize the enclosed porch. During this process the house sold. Now the previous property owner is here for the current property owner to legalize the enclosed porch. Michael Medd,previous property owner explained how when he purchased the home in 2001, this open permit did not come up on his title search. The porch was already enclosed when he purchased the home. Michael Izzo, Building Inspector pointed out that the public has access to all of their property records online from the Village website. He stated it's a good idea to check your records in advance so when you plan to sell your home it will not be a problem.
