Thank you for your response.
I suggest you start by retaining the services of a NY State Licensed Professional Engineer (P.E.), one familiar
with mesa style retaining walls and property re-grading to assist you with your site plan and permit
applications. Unfortunately the Village Code of Ethics prevents Village Employees from suggesting or
recommending contractors, architects, attorneys, or any other professionals or workmen to residents or
permit applicants. I would also suggest that you consider someone local to the Rye Brook, Rye, Port Chester,
Harrison,Mamaroneck, or White Plains area who is familiar with Rye Brook.
As I stated to you yesterday, in order to avoid a summons(s) to Rye Town Court for multiple violations of
Village Code, you must respond to this email and provide a reasonable and acceptable timetable for initiation
of the approval and permitting process.

Thank you for your prompt response and for providing the emailed information.

After reviewing your information, Building Department property files for your property,
Village Code, and upon consultation with my Assistant who was present at your property
today, I can now provide the following information:
1. The re-grading of your rear yard and construction of the new retaining wall to facilitate
the pending new patio installation requires Site Plan Approval from the Village
Planning Board under Village Code§209-1.B.(9).
2. The materials and aesthetics of the new retaining wall and pending patio requires an
Exterior Building Permit and approval from the Village Architectural Review Board
under Village Code§91-2. and 8-8.
3. The interior work performed to eliminate partition walls and perform electrical work
requires an Interior Building Permit under Village Code §91-2, and an Electrical Permit
filed by a Westchester County Licensed Electrician under Village Code§113-6. The
interior work may be combined on the Exterior Building Permit if you wish, however
given the time required to obtain Planning Board and Architectural Review Board
approvals it may be expeditious to file separately.
All the work, both exterior and interior require designed drawings prepared and sealed by
either a NY State Registered Architect or NY State Licensed Professional Engineer.
Topographical information is required for the re-grading and new retaining wall. A current
property survey must be submitted with the Site Plan Application and Exterior Building
Permit Application. The Site Plan Application as well as the bulk standard pages of the
Exterior Building Permit Application must bear the notarized signatures of your design
professional. The Interior Building Permit Application requires just your notarized signature.
I have attached all the applications and various other information hereto for your review and
convenience. Please read through the application materials and feel free to contact this office
should you require any further assistance.
Please note that unauthorized removal of the STOP WORK ORDER placard and/or failure to
obey the STOP WORK ORDER are violations of Village Code returnable at$1,000.00 per day
per violation.
