On March 25, 2021, 900 King Street Owner LLC (the “Applicant”) submitted supplementary materials to
the Planning Board in support of its applications for a PUD Site Plan, a Wetland Permit, and a Steep Slopes
permit. The Village’s consultants, Hardesty & Hanover and HDR, Inc., provided written comment
memoranda regarding the submitted materials. This memorandum provides responses to those consultant
comments.

4. Wetlands Permit
a) Off-site wetland mitigation is proposed within Rich Manor Park. This location was chosen by the
Superintendent of Public Works in coordination with the Applicant. Sheet L-303 depicts the
location.
b) Depiction of the areas to remain unmowed have been added to Sheet C-300.
c) The Wetland Buffer Planting Plan, Sheet L-302, has been updated to add woody species to the
wetland buffers.

10. Traffic, Transportation and Parking
a) Comment noted.
b) Site distance calculations were performed at both driveways in consideration of the existing and
proposed landscaping. They are shown on the newly added Sheet C-330, “Intersection Site
Distance.”
11. Construction Management Plan
a) The contacts will be listed prior to the receipt of a demolition permit and will be updated
throughout the construction processes, as necessary. The EFS requires that the Materials
Management Plan “be prepared by the Applicant prior to the start of excavation or ground
disturbing activities.” As the MMP is a technical workplan, which includes information based on
the final approved site plan and any conditions thereof, it cannot be finalized prior to Site Plan
approval. The Applicant understands that any Site Plan approval for the Project will be
conditioned on the preparation of an MMP consistent with the EFS. Further, the Applicant
understands that demolition and construction permits will not be issued until completion of the
MMP. It is noted that the MMP will include the measures outlined in §M.2.a of the EFS related
to soil handling and contingency measures to be implemented if unknown soil conditions are
encountered. As required by §B.1.b of the EFS, the MMP will also reiterate that, “No blasting or
rock crushing shall be permitted without further review and approval by the Village Building
Inspector.”
b) Sheets C-110 and C-130 have been updated.
c) Section 10.1, “Physical Noise Mitigation,” of the CMP has been revised. See the response to HDR
memo below.
12. Site Plan
a) Note #12 of the General Construction Notes was added to Sheet C-000 specifying that solid waste
and recycling shall not be picked up prior to 6 A.M.
b) Sheets C-600 and C-909 have been updated.
c) Sheet C-910 contains the required specifications and details.

General
The Applicant understands that construction of the project will involve specific permits and approvals from
the Village, including demolition and building permits. The Applicant will continue to coordinate with the
Village’s Building Department during the construction process. Demolition and building permits must
conform with the requirements of state and local law, and must be consistent with the requirements of the
EFS and any Site Plan conditions of approval.

Construction Management Plan
General
The text was updated to define “EFS” on page 4.
The following text was added to Section 10.2 of the CMP, “Site Layout and Policy-Based Noise
Mitigation:” The hours of operation during construction shall comply with the time of day and day of
week requirements of Chapter 158 of the Village Code.” Note #8, to the same effect as the above
language, was added to Sheet C-000.
Air Quality
The requested text edits to Section 7 were made.
Noise
Sections 10.1.1 and 10.1.2 were updated to clarify that the construction period noise barriers shall be
maintained throughout construction and demolition.
Sheet C-200 has been updated to more clearly show the proposed location of the construction period
noise barrier.
Section 10.1.1 was updated with the requested text.
Section 10.2 was updated with the requested text.
Path controls are provided in the form of the perimeter noise barrier. Therefore, additional path controls
are not required.
Vibration
The requested text was added to Section 9.
The warning and permissible threshold levels were added to the CMP, along with language requiring
the cessation of construction activities that result in exceedances of the permissible level.
Hazardous Materials
The requested text was added to Section 3.3.
The requested text was added to Section 3.3.

Comments on Site Plan Approval Drawings
General
Note & #7 under the General Construction Notes of Sheet C-000 was added, which requires compliance
with the CMP.

The following text was added to Sheet C-000 as Note #8: “The hours of operation during construction
shall comply with the time of day and day of week requirements of Chapter 158 of the Village Code.”
Air Quality
Sheet C-200 was updated to clarify that the existing asphalt driveways shall be utilized as the stabilized
construction entrance/exits during Phase 1 of the Project’s construction.
Item #3 on Sheet C-200 was updated as indicated.
Phases 1, 2, and 7 will not include concrete work.
A note requiring that stored materials be covered in certain situations was added as Note #9 under the
General Construction Notes on Sheet C-000.
Note #10 was added to Sheet C-200 noting that on-Site construction vehicle speed shall be limited to 5
mph, consistent with the requirement of the EFS and CMP. Signs to that effect will not be installed
throughout the Site given that the construction periods in which the speed restriction is most critical are
those in which defined roadways and paths will not yet be created.
Note #10 under General Construction Notes was added to Sheet C-000 stating that trucks shall not idle
for longer than three minutes.
Noise
Sheet C-200 was updated to show the location of the noise barriers, and Sheet C-010 was updated to
show the noise barrier symbols.

Vibration
Item #5 on Sheet C-200 was updated as indicated.
Item #17 on Sheet C-200 was updated as indicated.
Note #11 under General Construction Notes on Sheet C-000 was added requiring compliance with the
Vibration Monitoring Plan.
Note #12 under General Construction Notes on Sheet C-000 was added to clarify that completion of a
Materials Management Plan that is approved by the Village’s Special Engineering Consultant is
required prior to construction, demolition, or site disturbance.
Items marked “Complete” in the crosswalk table were submitted to the Village for review. The
Applicant understands that Village staff, consultants, and Boards can and will have comments on those
submissions.
Sheet C-910 contains the required specifications and details with respect to the generator and enclosure.
The following items are discussed within the “Project Description” narrative, submitted as part of the
Site Plan application and may not be appropriate to list on Site Plan drawings: restricting deliveries
during overnight hours; installing a mechanical system in compliance with the EFS requirements with
respect to acoustics.
