Your understanding regarding encroaching architectural features is correct, however the roof overhang is not in question here. According to your plan sketch REV 13 the bold black line represents the porch platform. That bold line is clearly encroaching over the red dotted line intended to represent the front yard setback line. Therefore since the porch platform is encroaching and such structural platform cannot be considered an architectural feature the application is inconsistent with the zoning code and cannot be forward to the ARB at this time. Instead the plans must be re--designed in compliance with the code or the application denied and brought before the Zoning Board of Appeals for consideration. Once I receive a sealed, dimensioned site plan as requested I will be able to draft the Notice of Disapproval letter needed to initiate the variance process.
