SUBJECT: 900 King Street Redevelopment Site Plan Rye Brook, New York DATE: March 6, 2021 With regard to the above mentioned project, this office has received and reviewed the following: 1. Plan entitled: "Site Plan Approval Drawings, 900 King Street Redevelopment", prepared by JMC, February 18, 2021; 2. Preliminary Stormwater Pollution Prevention Plan (pSWPPP) prepared by JMC, dated February 18, 2021; Our preliminary comments are as follows: 1.) It should be noted that our office reviewed Preliminary Site Plans during the EIS process where much detail was covered; this review continues that process. 2.) The disposition with regard to ownership and maintenance of the proposed sewer mains should be called out on the site plan. 3.) Both the proposed water and sewer mains will require approval from the Westchester County Department of Health. 4.) Sufficient scouring velocities should be demonstrated for the proposed sewer main with respect to expected flow rates. 5.) As detailed in the FEIS and previous responses regarding the water system, certain planned upgrades to be performed by Suez were made a condition of this development. SUEZ has previously provided a "willingness to serve" letter, contingent on these upgrades and proposed water main extension associated 900 King Street Site Plan March 6, 2021 Page 2 Improving Life. By Design. with the project to be completed within 9 months of the letter dated February 1, 2019. This letter must be updated by SUEZ and a schedule regarding completion of the planned upgrades provided by the applicant. 6.) As detailed in the EIS the applicant has committed to Inflow and Infiltration (I&I) removal of 80,000 gpd. A decision as to meeting this goal through a specific project-based mitigation or through monetary contribution to the Village must be decided. 7.) It should be noted that our office is currently conducting a more detailed review of the provided Preliminary Stormwater Pollution and Prevention Plan and associated calculations. The overall proposal does include a reduction to impervious areas on this site which is consistent with previous pSWPPP submittals. 8.) It is noted that 25 parking spaced have been included as “land banked”. 9.) The proposed fire truck access plan and onsite fire protection plans must be reviewed by the Village Fire Department and Building Department for code compliance and operational considerations. 10.) Construction phasing, sediment & erosion controls and associate staged disturbance areas have been reduced and sequenced as a result of previous comments during the EIS process. However, disturbance phases do still exceed the maximum area as allowed by NYSDEC; this will require a NYSDEC waiver for disturbance areas in excess of 5 acres at one time. As such, it is critical that each phase and sub-phase be stabilized in strict conformance with the approved site plan. Prior to initiation of each phase; the Village must verify that necessary stabilization measures have been completed before authorizing the contractor to proceed on to the next phase. This should be made a condition of approval so that special attention is paid to these critical construction procedures. Failure to do so may result in excessive runoff of silt during construction.
