RESOLUTION
GRANTING PRELIMINARY AND FINAL SUBDIVISION APPROVAL
(LOT MERGER) FOR PROPERTY LOCATED AT
32 AND 34 BONWIT ROAD
VILLAGE OF RYE BROOK BOARD OF TRUSTEES
WHEREAS, Mr. Ronald Rettner, property owner, submitted an application for
approval of a subdivision plat merging the lot at 34 Bonwit Road, Section 135.50, Block 1,
Lot 31 as shown on the Town of Rye Tax Map with the adjacent lot at 32 Bonwit Road (also
owned by Mr. Rettner), Section 135.50, Block 1, Lot 30 as shown on the Town of Rye Tax
Map in the R-12 District; and
WHEREAS, the Village of Rye Brook Planning Board is the Approval Authority for
this application pursuant to Sections 179-2.A(1) and 219-2.B of the Village Code; and
WHEREAS, the Planning Board reviewed the following plans and application
materials:
1. Short Environmental Assessment Form and EAF Mapper Summary Report
2. Application for Subdivision of Land
3. Map of Survey and Lot Merger, prepared by William E. James, P.E., P.L.S.,
Wallkill, NY dated June 6, 2017; and
WHEREAS, the proposed action is a Type II action pursuant to the State
Environmental Quality Review Act (SEQR); and
WHEREAS, the Village Planning Consultant, Village staff and the Planning Board
reviewed the information and submitted comments regarding the subdivision; and
WHEREAS, the application proposes to merge the total lot area of 34 Bonwit Road,
which is 16, 672.03 square feet, with the total lot area of 32 Bonwit Road, which is
20, 321.11 square feet, thereby creating one 36,993.14 square foot lot; and
WHEREAS, on August 10, 2017, the Planning Board opened a duly noticed public
hearing on the subject application, at which time all persons interested were given an
opportunity to speak on behalf of or in opposition to said application and the Planning
Board closed the public hearing on August 10, 2017; and
WHEREAS, the Planning Board is familiar with the site and all aspects of the
project.

NOW THEREFORE BE IT RESOLVED, that the Village of Rye Brook
Planning Board hereby grants Preliminary Subdivision Plat Approval, as shown on the
application materials enumerated above.
BE IT FURTHER RESOLVED, the Planning Board hereby finds that the Final
Subdivision Plat will not be substantively changed from the Preliminary Subdivision Plat and
hereby determines that a public hearing on the Final Plat is not required.
BE IT FURTHER RESOLVED, that the Planning Board hereby grants Final
Subdivision Plat Approval, as shown on the application materials enumerated above, and the
Planning Board Chairman is authorized to sign such plat subject to the following conditions
and modifications which must be satisfied prior to the signing of the Final Plat by the
Planning Board Chairman:
a. The Applicant shall prepare a Final Subdivision Plat in accordance with Section
219-32 of the Village of Rye Brook Subdivision Regulations, which shall include
the Town of Rye tax lot designations for the subject lots. Upon obtaining a
satisfactory review by the Village Engineer/ Superintendent of Public Works, the
Final Subdivision Plat shall be submitted for review and signature to the
Westchester County Department of Health.
b. The Applicant shall submit a statement signed by the Town of Rye Receiver of
Taxes that all taxes due for both lots have been paid.
c. All applicable fees and professional review fees incurred in connection with the
review of this application shall be paid in full; and
BE IT FURTHER RESOLVED, that this conditional approval of the Final
Subdivision Plat shall expire one hundred eighty (180) days from adoption of this resolution
unless all conditions set forth above have been certified as completed and the Final Plat has
been submitted for endorsement by the Planning Board Chairman, or unless a written
request for an extension of Final Subdivision Plat Approval is granted by the Planning
Board. The Planning Board may grant ninety (90) day extensions to said time period.
BE IT FURTHER RESOLVED, that once the Final Subdivision Plat has been
endorsed by the Planning Board Chairman, said plat must be filed in the Westchester County
Clerk’ s Office within sixty-two (62) days. After said filing, two (2) copies of the Final Plat
shall be submitted to the Village.
BE IT FURTHER RESOLVED, that no permits shall be issued by the Building
Department until the Applicant has paid to the Village all applicable fees and professional
review fees incurred in connection with review of this Application.
