While not an adjacent neighbor, I live a block away and have recently appeared before the Planning Board to oppose a similar application. In my case, our adjacent neighbors had constructed a new swimming pool and,without notice or further application,placed their filter and heating equipment close to our property line, in violation of their approved plans and the applicable provisions of the Village Code. A pattern of non-compliance appears to be growing in our community, which is concerning. In the case of the Zislis application for a variance to the Zoning Ordinance, the strategy that has become increasingly popular in Rye Brook is being employed: that of constructing, installing or placing what the homeowner prefers, although not compliant with approved plans or the Village Code, and then, upon appropriate rejection by our Building Department of the request for a Certificate of Occupancy (for failure to be in compliance), making application to the Board for legalization. It would seem that in this community, asking for forgiveness after the fact (legalization) rather than permission in advance has gained a reputation as the easier, faster, cheaper, and more efficient approach, and as the one that is likelier to succeed. As this Board is aware, the standard in evaluating a request for legalization is whether the Board would have approved the variance if requested prior to the non-compliant construction or placement having been undertaken. I would suggest that there would have been no compelling reason to have approved this variance then, and that the inconvenience and cost of correcting their non- compliance now are not legitimate factors to be considered as part of this application. It is clear from the face of their application that the non-compliant placement of the equipment was made for the purpose of decreasing sound for the Zislises by placing it further away from their terrace and closer to their neighbors' property line; as an afterthought, they allege that it also happens to be a better location for their neighbors. Their argument compels acceptance of their suggestion (the most common argument that is made in legalization proceedings) that their contractor was unaware of the 10-foot setback requirements; that the homeowner was unaware of what their contractor was doing until the placement was completed (note that this same homeowner requested and was granted variances by the ZBA in 2007); that their architect Mr. Scarlato (one who has worked on plans in this community and appeared many times before Village boards before, and in fact worked with the Zislises in 2007), and their lawyer were also unaware that the setback rules were being violated until afterwards. The casual disregard for the rules and regulations that we have chosen to live by in this community (including, in this case, failure to provide required public notice for the December 2022 ZBA meeting, necessitating the adjournment of this application) has become commonly acceptable. But this approach impairs the validity and purpose of code provisions that were adopted after careful drafting, review, debate and adoption by boards such as this one. And obtaining letters of"support" from one's neighbors (consisting of pre-printed recitations of no objection drafted by the Applicant), who may be understandably reluctant to object to signing, is not persuasive as to the advisabililty of continuing to erode the integrity of our Village Code by making exception after exception. It is puzzling that almost a year has elapsed between the denial of a Certificate of Occupancy by the Building Department in November 2021 and the submission of this application; it raises the question as to whether the equipment was used during that time without authorization of any kind. And is there an acceptable plan to comply with Section 224-7.C. of the Code that requires such equipment to be located "underground or buffered to minimize noise": adequate, comprehensive screening or plantings, and/or sound reducing equipment ? The alleged "hardship" of a disturbance to their property if required to relocate the equipment in order to comply with the Code is of their own making;it is entirely self-created. And it could easily have been avoided. It is not a compelling reason to grant a variance and further encourage non-compliance with the Code and with plans that have been approved by the boards of this Village and by the Building Department.
