preliminary Final Environmental Impact Statement (pFEIS)
PUD Concept Plan and Preliminary Site Plan (3rd draft)

With regard to the above mentioned project, this office has received and reviewed the
following:
1. 900 King Street Redevelopment, preliminary Final Environmental Impact
Statement (pFEIS), and appendices dated July 2, 2020 and prepared by AKRF,
Inc.
2. Plan entitled: "PUD Concept Plan and Preliminary Site Plans, 900 King Street
Redevelopment", prepared by JMC, last dated December 13, 2019;
Our comments with regard to the pFEIS remain as follow:
1.) As noted in our June 14, 2019 memo, the previous response regarding the water
system notes certain planned upgrades to be performed by Suez. Therefore, it is
critical that the changes to the Suez system be made conditional to any
approvals and the proper means to enforce these conditions and substantiate
their implementation be considered.
2.) As noted in our June 14, 2019 memo, the applicant has adjusted expected
sewage flows from the project in accordance with the reductions proposed. As a
result, the net increase to sewage flows is now calculated to be 27,757 gpd. This
will result in required Inflow and Infiltration (I&I) removal of 83,271 gpd. The
pFEIS states that the applicant proposes to meet this by monetary contribution to
the Village’s existing I&I program. This monetary amount should be established
by the applicant in conjunction with the Village and its consultant’s prior to final
approval and noted in the FEIS. This is in accordance with the Westchester

County Departments of Planning and Environmental Facilities recommendations
and should be made a condition of any future site plan approval as well.
3.) It is noted that a final review of construction phasing, sediment & erosion controls
and Stormwater Pollution and Prevention Plan will be conducted during Site Plan
Review.
