Response to pFEIS and AKRF Memorandum dated January 3, 2020.

This response is based on our review of materials submitted by Veneziano & Associates,
Counsellors at Law, (V&A) on behalf of the property owner, 900 King Street Owner
LLC (the Property Owner) and include;

As stated above only a partial Site Plan Application was submitted and to date we have
yet to receive the Exterior Building Permit Application.
Attached for your convenience are copies of the June 21st ESTF Memo and of the AKRF
Memorandum dated January 3, 2020 written in response to the June 21st ESTF Memo. I
call your attention to the numbered items on pages 5 and 6 of the AKRF Memorandum.

3 - The ESTF stresses that site grading and impervious coverage considerations
should not be given precedence over public safety. The initial submittal included
two remote vehicle entry/exits and the reasons given by the applicant for the
reduction to a single point of vehicle entry/exit are unsatisfactory. The ESTF
requests a re-design of the parking area showing two remote vehicle entry/exits
along with a designed mechanical ventilation system adequate to purge the entire
garage area of smoke and/or noxious fumes in a fire/smoke event.
o RESPONSE: Together with the Village’s Counsel, we developed a
proposed approach to advance the FEIS process prior to a final decision on
the second vehicular entrance to the garage. As part of this proposed
approach, we provided proposed text changes to the FEIS that document
the ESTF's opinion that a second entrance is needed for the reasons
specified in its correspondence. We also added text stating that the
Applicant disagrees that the entrance is needed. Finally, the revised FEIS
states that the BoT will ultimately make the decision as to whether the
second entrance is needed at the time of Site Plan approval as such
decision is more closely aligned with issues of building code compliance
and final site details and does not significantly affect the environmental
impacts of the project.
4 - The ESTF requests that no less than two (2) of the proposed five (5) elevators
serving the IL building and garage be sized to accept an EMS gurney. The AL
building should also be equipped with two (2) such sized elevators. Please note
that the Atria Senior Living Facility is equipped with two (2) EMS gurney sized
elevators.
o RESPONSE: As discussed at our 2/18/2020 meeting at Village Hall, all
elevators in the IL and IL building will be sized to accept a gurney.
8 – The ESTF has determined that the roof and parapet design will greatly hinder
any attempted roof firefighting or rescue operation and will place Firefighters and
the public at an elevated risk accessing or escaping the building to/from the roof
during a fire event. The proposed parapet heights of 69” and 93.5” will also block
any view from the ground of persons who may be trapped and/or incapacitated on
the roof. The ESTF requests a re-design of the roofline/parapets to enhance
public and first-responder safety.
o RESPONSE: A solution to this concern was discussed and agreed upon at
the 2/18/2020 meeting at Village Hall. The architect will add full width
platforms and steps on the back side of parapets at roof areas adjacent to
aerial apparatus staging spots. In addition, roof mounted ladders will be
added to allow firefighters to traverse from roof to roof. Pending final
design, portions of the false mansard roof in some of the areas facing the
Parkway may be removed. These changes will be added to the site plan
drawings following approval of the zoning text changes.
11 - The applicant has failed to address Fire Department Ladder and Bucket
Truck cab-in access to the buildings/roofs.
o RESPOSNE: As discussed at our 2/18/2020 meeting at Village Hall, cab-
in access will be provided at certain locations around the building. The
locations would be reviewed and approved by the Village during final Site
Plan review, when the final building and site details are determined.
12 - The applicant has addressed communications inside the building, but has
failed to address communications between emergency personnel inside the
building and emergency personnel outside the building, or with remote
emergency command posts.
o RESPONSE: As discussed at our 2/18/2020 meeting at Village Hall, the
precise method by which the communications concerns of the Village’s
first-responders will be addressed, including the products, vendors, and
building/site locations of any equipment, will be determined during
development of the building permit drawings. Until the building’s final
design is complete and approved by the BoT, it is not possible to finalize
the communications equipment.
OTHER: The ESTF points out that the proposed site plan is devoid of an area(s) near or
adjacent to the main entrances dedicated for the parking/staging of emergency vehicles.
Such an area(s) eliminate the inevitable traffic conflict between emergency and private
vehicles located at/near the main entrances during an emergency. Neither the IL Building
nor the AL Building provide such an area. The ESTF recommends that the applicant
design such areas at or near the main entrances of the IL and AL Buildings.
Please note that the Atria Senior Living Facility does provide a dedicated emergency
vehicle area adjacent to the main entrance.
RESPOSNE: As discussed at our 2/18/2020 meeting at Village Hall, the
final site plan will provide for dedicated space for an ambulance/
emergency services at the main entrance to both the IL and AL. This will
be accomplished by reducing the number of convenience, accessible
spaces at the IL and modifying the driveway at the AL. The project would
still provide at least the required minimum number of accessible parking
spaces.
