The first page of the Building Permit application states: "A building permit shall expire six months after its date of issuance if construction has not commenced. If construction has commenced within the six month period as set forth in this subsection, the building permit shall expire 12 months after its date of issuance if all of the proposed work has not been completed or a temporary certificate of occupancy has not been issued. Construction shall be deemed to have commenced when significant construction work on the project, as described on the building permit, has been performed. The Building Inspector shall have the authority to determine whether construction has commenced, and his or her decision shall be final." (§91-2.b. Code of the Village of Rye Brook) Please note that should you fail to properly close out your permit prior to the expiration date in accordance with the law,you will be liable for the $500.00 Administrative Fee in connection with all expired Building Permits issued after January 1, 2003. Please note that this Administrative Fee applies to each individual permit and must be remitted in addition to any other required fees associated with closing the permit, as well as any court imposed fines should a summons be issued." This application is signed and notarized by both the property owner and the applicant (if different than the homeowner) indicating that they are familiar with and have read the application. Then, each building permit that is issued (which should be visibly posted on the home viewable from the street), has four (4) references to this regulation including the amount of the fine. They include: 1) On the front of the permit is the issue date and expiration date. 2) On the front of the permit it says that the permit is valid for a period not to exceed twelve (12) month from the date of issuance. 3) On the front of the permit it states (in red) that "A Certificate of Occupancy or Certificate of Compliance is required in order to close out this permit" 4) On the back it states to post the permit in a front window or other visible location so it is visible from the street, and that "all building permits have a life span of twelve (12) months as noted on the front of your permit, and must be closed out prior to the expiration date with a Certificate of Occupancy or Certificate of Compliance in accordance with Section 250-10(A) of the Code of the Village of Rye Brook". S) On the back is the statement that "[p}lease be advised that should you fail to properly close out your permit(s) prior to the expiration date shown on the front of this permit, the Village will impose a $500.00 Administrative Expired Per Fee. Please note that this Administrative Fee applies to each individual permit..." 1 In general,the purpose of closing building permits is to make sure the completed work reflects the application and was done properly meeting the applicable codes. Without a C of 0, no one should be occupying or using the spaces of work reflected in the application (this obviously would not apply for fences, windows,etc) because in some cases these areas may not be safe to occupy. This information is sent to the Town of Rye to properly reflect the improvements in the home for tax assessment purposes. I hope this addresses many of the issues raised in your email below and demonstrates that we try our best to make sure everyone is informed on these issues. I have done permits like this in other towns where I have lived and had never been asked to "close out a permit" when work is completed. It never occurred to me to do so. . What is the purpose of such a penalty? What benefit does the town incur by having such a policy? If someone from the town can send a letter informing residents when they owe the money why isn't there a process in which the town also sends a letter warning people that the expiration date is approaching? It is hard to understand the purpose of such a fee other than to extract money from unsuspecting residents of the town.
