He introduced the members of the Board, Village staff, and the liaison from the Board of Trustees, Trustee David Heiser. He instructed anyone addressing the Board to come to the podium, use the microphone, state their name, address, and the nature of the application. Chairman Moscato noted that Steven Berger resides within the notification area for the first application on the agenda. Mr. Berger recused himself, leaving four members of the Board. Chairman Moscato called for the first item on the agenda. 1.1. 919-016 Bradley Scharf & June Scharf 8 Magnolia Drive Construct a rear one-story addition and new rear deck Mr. John Scarlato, Jr., architect for the applicants addressed the Board. He noted that the applicants were in the audience, available to answer questions. He began his presentation by noting that the proposed construction is to the rear of the home. He presented the plans which showed the area of the addition and the elevation. The one-story addition will take the galley type kitchen and create an open, L-shaped kitchen and add a family room. As part of the application, the old deck will be removed to construct the addition and a new deck. A discussion ensued about gross floor area and lot coverage. Mr. Michael Izzo, Building Inspector noted that the Village Code did not have gross floor, height setback ratio, or lot coverage restrictions when the home was built. He confirmed that the applicants received a variance in 2006 in connection with the gross floor area, along with a variance for building coverage. Mr. Scarlato noted that at this time the applicants are requesting a 325 square foot gross floor area variance. He pointed out that there are other homes on Magnolia Drive that are also over the square foot floor area coverage. He reviewed similar sized properties in the area. Chairman Moscato asked for confirmation from Mr. Izzo that the houses in this area that are over the gross floor area were built before the Zoning came into effect. The fact that this property had already been granted a variance in 2006 in connection with the gross floor area and main building lot coverage was discussed. Mr. Scarlato stated that the size of the family has changed and their needs are different now. Every situation is different. Mr. Scarlato noted that things change in ten -- fifteen years. This family has grown and they need additional living space. This could not have been anticipated when the construction in 2006 took place. The kitchen is no longer sufficient. Many people just move on, but this family would like to stay in this home and in Rye Brook. The changes that are proposed will not affect the character of the neighborhood. There have been applications where an addition was made and then a year or two the Zoning Board of Appeals February 4, 2020 Page 2of9 applicants were before the Board with additional variance requests. This is not the case for this application since about 14 years has passed. Mr. Scarlato presented the Board with plans for the proposed construction showing the existing home and area of the proposed changes. Chairman Moscato felt that it was a large jump in size for a home in an R15 zone. Chairman Moscato felt that a home that size belongs in an R20 zone. Mr. Izzo noted that there was a F.P. Clark Assoc. report regarding upzoning. Said report did not change the zoning criteria of this area. This was an R15 zone and it remained an R15 zone. The changes made to the Zoning Code were done to control construction and the size of the homes. At that time the larger homes were referred to as McMansions. The goal of the Zoning Board is to minimize the size of variances and in this matter the consensus of the Board was that the size of the construction and variance could be reduced. Mr. Scarlato stated that the current plan is very tight. When drawing up the plans the applicants took into consideration the smallest sized variance needed to meet their needs. The proposed construction is in the rear of the home, and no one will be able to see the proposed addition from the road. The Board reviewed information on other homes in the area presented by Mr. Scarlato. It was felt that additional information on variances in the area would assist the Board in making their determination. Chairman Moscato called for members of the public wishing to address the Board in support or opposition. There being no one - the matter was put on "pause" to allow Mr. Izzo time to review whether the larger homes in the area received variance approval from the Zoning Board for gross floor area. Chairman Moscato noted that the second matter on the agenda was adjourned at the applicants' request. 1.2 019-014 Lawrence Rose and Lauren Rose (Adjourned by Applicant) 39 Meadow Lark Road Construct a two story front porch, new rear deck and Interior alterations ADJOURNED Chairman Moscato called for the next item on the agenda: 1.3 #20-001 Edward Holleran and Nancy Holleran 7 Ridge Boulevard Legalize the existing two car garage addition permitted on 8/22/1953 Zoning Board of Appeals February 4, 2020 Page 3 of 9 Kimberly Martelli, the architect for the applicants, addressed the Board. She gave a brief history of the property. The lot, located on Ridge Boulevard, is a corner lot and a permit was issued in 1939 with a certificate of occupancy issued in 1940. Subsequently, in 1953, an application was made to construct a breeze way and two car garage, and alter the existing garage into a den, lavatory and laundry. That work was done but there is no history of a Certificate of Occupancy being issued. The next application was made in 1963 for alternations to a screened in porch and the permit was issued in 1970. In 1985 a Certificate of Occupancy and approval which included the 1953 application was issued. The goal is to make sure that the proper approvals are in place. Mr. Izzo, Building Inspector, noted that it was at the Village's suggestion that this matter be heard by the Zoning Board of Appeals so that the record could be cleaned up. Ms. Martelli noted that when the homeowners purchased the property, they purchased it with properly permitted additions. Chairman Moscato pointed out that because this is a corner lot there are two front yard setbacks. The minimum required front yard setback is 25'. It was also noted that there is no other place on the property that the garage could be constructed. Chairman Moscato called for members of the public wishing to be heard in support or opposition to the application. There being no one, the public portion of the hearing was closed and the Board began deliberation. Attorney Gamils was asked to craft a condition for the resolution. Mr. Izzo noted that he located additional information on neighboring properties that are above the permitted gross floor area. Mr. Izzo reviewed this information with the Board. June and Bradley Scharf, applicants, addressed the Board. Ms. Scharf noted that in fourteen years their family structure has changed. Fourteen years ago the kitchen size was sufficient and they did not consider making it bigger, but now with a larger family it has become an issue. She felt that the addition would meet their needs, allow them to stay in the home, and it would not affect the character of the neighborhood or any of the neighbors. It was noted that there is sufficient landscaping to screen the addition from adjacent properties. The consensus of the Board was that the variance requested was substantial. It was noted that although physically there are large houses in this area, the proposed addition will make this house substantially larger. Possible options were discussed, but none of these options met the applicants' needs. Chairman Moscato began a review of the application using the five factors used by Zoning Boards when determining whether or not a variance should be approved. She noted that a two-to-two vote would be a denial of the variance.
