Meder, AICP Jim Donovan, RLA, ASLA To: Rye Brook Mayor and Village Board of Trustees Date: July 8, 1994 Subject: Byram Ridge Zoning Study As per the direction of the Rye Brook Village Board of Trustees, this office has undertaken an analysis of the lot areas of individual lots located within the Byram Ridge Study Area utilizing the digitized information available from the autocad map discs prepared for the Town of Rye Tax Maps by Sewall. As you may recall, our office had performed some preliminary analysis based upon digitized measurements taken from hard copies of those maps. The Village Board had then directed that our office prepare a map with color coded lot areas based upon digitized measurements taken electronically from the autocad map disks. The results of this analysis have been completed and the color coded map will be presented to your Board at the July 12, 1994 meeting of the Board of Trustees. Significantly, the measurements taken electronically from the data discs are in substantial agreement with our previous analysis, which was based upon digitized measurements of the hard copy of the map. However, were the minimum lot size in the Study Area increased to 25,000 square feet, more than 1 in 3 lots would not meet the minimum lot area size (19.1% + 15.1% = 34.2%, or more than 1 in 3). Additionally, if the minimum lot size for the Study Area were increased to 30,000 square feet, more than one-half of all of the lots in the Study Area would not meet the minimum lot area standard (34.2% + 18.4% _ 52.6%, or more than 1/2 of the lots). Further analysis, based upon an examination of the ownership records of the lots and the applicability of Rye Brook's lot merger provisions (see Section 66-6.A.2 of the Zoning Law of the Village of Rye Brook), could be expected to have a minor effect upon the numbers and percentages contained within the table above. However, we do not believe that such further refinement would yield significantly different results. We are concerned about rezoning the minimum lot size within the Study Area and creating a situation where either close to one-third of the lots or one-half of the lots were rendered non -conforming with regards to this very basic bulk standard (i.e. minimum lot area). Furthermore, as is evident when reviewing the color coded lot area analysis map that we will present to your Board at the July 12, 1994 meeting of the Board of Trustees, the larger lots are not concentrated within any one specific section of the Study Area. Planning/Development/Environment/Transportation While the smaller lots do tend to be clustered together in groupings, these groupings are scattered throughout the Study Area. Consequently, there does not appear to be any substantially sized, easily demarcated sub -area within the Study Area that could be readily identified as appropriate for R-25 or R-30 zoning if such an area is not to incorporate a substantial number of undersized lots. As originally requested many months ago, we have revised the map so that it identifies all lots within the study area exceeding 40,000 square feet in lot area. For your convenience, we have also summarized, in the table below, the number and percentage of lots in each lot area category indicated on the map.
