Rosenberg, Mayor and the Village of Rye Brook Board of Trustees Date: September 6, 2018 Subject: 900 King Street, Petition to Amend the PUD Regulations and Application for a PUD Concept Plan – Second Completeness Review of a Proposed Draft Environmental Impact Statement As requested, we reviewed additional revisions to the revised, proposed, Draft Environmental Impact Statement dated “Revised July 20, 2018,” submitted to the Village of Rye Brook Board of Trustees by Rye King Associates, LLC, as part of a petition to amend Section 250-7 E, Planned Unit Development (PUD) regulations of the Village Code and an application for a PUD Concept Plan regarding the property located at 900 King Street, Town of Rye Tax Parcel 129.68-1-13, to construct 269 units of age-targeted housing and related infrastructure, including driveways, walkways, garage and surface parking, site lighting, signage and stormwater management facilities. The new revisions of the DEIS were reviewed for the purpose of determining if the document is sufficiently complete and adequate with respect to scope and content for public review. The revised DEIS was reviewed against the Final DEIS Scoping Outline (the “Scope”) adopted by the Lead Agency, the Village of Rye Brook Board of Trustees, January 23, 2018. COMMENTS 1. The additional revisions to the July 20, 2018 proposed DEIS were submitted by the Applicant in response to the comments in our August 10, 2018 review memorandum to the Trustees. After review of all the new revisions to the document, it is our opinion that the latest version of proposed DEIS, which includes revisions submitted for review August 14, 2018 and September 4, 2018, is “adequate with respect to its scope and content for the purpose of commencing public review.” 2. Our review comments address the scope of the information provided by the document, its completeness and accuracy, and the ability of the public to easily access information and topics included in the DEIS. This memorandum does not provide comments regarding the substance of the Proposed Action. 2 3. A substantive review of the document will be the next step in the environmental review under SEQRA, after the Board accepts the DEIS and authorizes notice of its completion, and distribution of the document to all involved and interested agencies for review and comment.
