Bradbury, Village Administrator Greg Austin, Police Chief Edward Beane, Esq., Village Counsel Michel Nowak, Superintendent of Public Works Fred Seifert, Public Access Coordinator Shari Melillo, Meeting Secretary 1 7:15 P.M. -EXECUTIVE SESSION: a) Personnel appointments. 2 7:30 P.M. -REGULAR MEETING: 3 PLEDGE OF ALLEGIANCE: 4 REPORT/PRESENTATIONS: 5 PUBLIC HEARINGS: Page 1 of 10 Board of Trustees May 9, 2017 6 RESOLUTIONS: a) Considering approving use of Village Streets for the 2017 Wall Street Rides Far ("For Autism Research") event. Mr. Bradbury read the resolution: RESOLUTION CONSIDERING APPROVING USE OF VILLAGE STREETS FOR THE 2016 WALL STREET RIDES FAR("FOR AUTISM RESEARCH") EVENT THEREFORE BE IT RESOLVED, that subject to the final approval of the Rye Brook Police Department, The Autism Science Foundation is authorized to use the Village of Rye Brook streets for the 2016 Wall Street Rides FAR ("For Autism Research") Charity Bike Ride event on Saturday, October 7, 2017, requested in a letter dated April 27, 2017; and be it BE IT FURTHER RESOLVED, that Village streets shall be used in compliance with the terms and/or conditions established by the Village of Rye Brook Police Department. According to Police Chief Austin, this will have very little impact on the Village. No major concerns. Mr. Bradbury read the resolution: RESOLUTION CONSIDERING THE APPOINTMENT OF A DEPUTY VILLAGE TREASURER NOW THEREFORE BE IT RESOLVED, that Pasquale Colantuono of 44 Crestwood Boulevard, Poughkeepsie, New York is hereby appointed to the position of Deputy Village Treasurer with the Village of Rye Brook, subject to the Civil Service procedures of the State of New York; and be it FURTHER RESOLVED, that the annual salary is $79,500 with an effective start date of May 19, 2017; and be it FURTHER RESOLVED, that for the purpose of the Village's annual reorganization meeting resolutions designating the Deputy Village Treasurer, that Pasquale Colantuono of 44 Crestwood Boulevard, Poughkeepsie, New York is hereby appointed as Deputy Village Treasurer for the Village of Rye Brook for the next ensuing official year. Board is very happy for Mr. Colantuono. He has been here since 2008 and does a great job in the Treasurer's Office. He is very personable - a hard worker and always willing to take on any task. Mr. Colantuono thanked the Board, Mr. Bradbury and his bosses, Treasurer Diane DiSanto and Deputy Treasurer Cathy Spinosa, who are both retiring this month, for all their support and guidance. For Against Susan Epstein (Moved By) x Jason Klein (Seconded By) x Jeffrey Rednick x 3 0 Page 3 of 10 Board of Trustees May 9, 2017 d) Considering approval of a Stipulation of Settlement between the Village of Rye Brook and the Rye Brook Professional Firefighters Mutual Aid Association Local 4041, IAFF. Mr.Bradbury read the resolution: RESOLUTION CONSIDERING A PPROVAL OF A STIPULATION OF SETTLEMENT BETWEEN THE VILLAGE OF RYE BROOK AND THE RYE BROOK PROFESSIONAL FIREFIGHTERS MUTUAL AID ASSOCIATION LOCAL 4041, IAFF WHEREAS, on March 15, 2017 a Stipulation of Settlement was agreed upon by the Village of Rye Brook and the Local 4041 Village of Rye Brook Professional Firefighters Mutual Aid Association (the "Rye Brook Firefighters Union") which includes a resolution and withdrawal of a pending arbitration with the Rye Brook Firefighters Union as well as a new three (3) year Collective Bargaining Agreement for the period June 1, 2017 through May 31, 2020. NOW THEREFORE BE IT RESOLVED, that the Village of Rye Brook Board of Trustees hereby approves the settlement including the new Collective Bargaining Agreement with the Rye Brook Firefighters Union for the period of June 1, 2017 through May 31, 2020, on the terms and conditions set forth in the Stipulation of Settlement signed by both parties on March 15, 2017; and be it FURTHER RESOLVED, that the Mayor and the Village Administrator are authorized to execute and deliver all documents necessary or appropriate to accomplish the purposes of this resolution. Deputy Mayor Rednick stated that Mayor Rosenberg was very disappointed that he could not be here for this but wanted him to convey his thanks to the Firefighter Union for their cooperation in coming to the settlement. Page 4 of 10 Board of Trustees May 9, 2017 Mr. Bradbury added that this ends the pending arbitration- the Village will hire two firefighters by September. The Village has already hired 2 firefighters and the agreement includes three years of salary increases, This would not have happened without the agreement that occurred this week with the Village of Port Chester ending the lawsuit with them For Against Susan Epstein (Seconded By) x Jason Klein (Moved By) x Jeffrey Rednick x 3 0 f) Considering a modification of the existing agreement between the Village of Rye Brook and A. Bulfamante, Inc. to operate a compost facility on municipal property at 411 Lincoln Avenue. Mr. Bradbury read the resolution: RESOLUTION AUTHORIZING THE VILLAGE TO EXECUTE AN AMENDMENT TO AGREEMENT BETWEEN THE VILLAGE OF RYE BROOK AND A. BULFAMANTE LANDSCAPING, INC. VILLAGE OF RYE BROOK BOARD OF TRUSTEES WHEREAS, on April 20, 2016 the Village of Rye Brook(the "Village") entered into a license agreement with A. Bulfamante Landscaping Inc.("Bulfamante") to operate, at no cost or expense to the Village, a compost facility on a portion of the Premises located at the existing Village compost site on Lincoln Avenue, adjacent to the Westchester County Airport (the "Agreement"); and WHEREAS, the Village and Bulfamante wish to enter into an Amendment to modify and supplement certain terms of the Agreement; and WHEREAS, the Board of Trustees is in receipt of the Amendment and the Village Counsel has confirmed the Amendment is in satisfactory form. Page 5 of 10 Board of Trustees May 9, 2017 NOW THEREFORE BE IT RESOLVED, that the Village Board of Trustees hereby approves the aforementioned Amendment to the Agreement between the Village and Bulfamante and authorizes the Mayor or the Village Administrator to execute and deliver all necessary documents to accomplish the purpose of this resolution, subject to any revisions deemed necessary by Village Counsel. Mr. Bradbury explained that we have a great relationship with the contractor running our compost site. The Village brings it leaves to the compost site and the weekly green waste as well. Mr. Bulfamante approached us and wanted a list of contractors that can come into the site be loaded up and leave the site - it is a defined list of 15 that can be modified at any time but never exceed 15. As part of that the compensation to the Village increases to $25000 per year They have amended the agreement with the following changes - vehicles should not be under 5 cubic yards in size - vehicles should have signs on the truck and the Village should have live access to the camera feed and lastly in the indemnification agreement- the address has to be updated. Mr. Bradbury read the resolution: Page 6 of 10 Board of Trustees May 9, 2017 RESOLUTION CONSIDERING A REQUEST FOR A WAIVER OF THE 30-DAY NOTICE REQUIREMENT FOR A RENEWAL OF A NYS ON- PREMISES ALCHOLIC BEVERAGE LICENSE BY VILLA RUSTICA PIZZERIA, INC. LOCATED AT 261 SOUTH RIDGE STREET WHEREAS, on May 3, 2017 representatives of Village Rustica Pizzeria, Inc. located at 261 South Ridge Street(i.e. Washington Park Plaza), submitted a 30-day notice to the Village of Rye Brook for the renewal of an On-Premise Alcohol Beverage License (the "License"); and WHEREAS, their current License is set to expire on May 31, 2017 which is less than 30 days from the delivery of the 30-day notice; and WHEREAS, in order to continue to operate with a License without interruption, the applicant is requesting that the Village Board of Trustees waive the 30-day notice period. NOW THEREFORE BE IT RESOLVED, that the Mayor and the Administrator/Clerk are hereby authorized to approve and sign the waiver of the 30-day notice requirement for a renewal application for an On-Premises Alcoholic Beverage License made by Village Rustica Pizzeria, Inc. located at 261 South Ridge Street. Deputy Mayor Rednick explained that this was a simple clerical error and that the filing was just two days late. Trustee Klein added that this is a simple renewal - not a new application and no changes to what is currently in place. For Against Susan Epstein (Seconded By) x Jason Klein (Moved By) x Jeffrey Rednick x 3 0 Page 7 of 10 Board of Trustees May 9, 2017 h) Considering setting a public hearing on a proposed local law modifying Section 160-3(A) of the Village Code regarding the size and display of the numbering of properties. Mr. Bradbury read the resolution: RESOLUTION CONSIDERING SETTING A PUBLIC HEARIN ON A PROPOSED LOCAL LAW MODIFYING SECTION 160-3(A) OF THE VILLAGE CODE REGARDING THE SIZE AND DISPLAY OF THE NUMBERING OF PROPERTIES. WHEREAS, the 2016 International Property Maintenance Code (IPMC) which is currently in effect for municipalities in the State of New York, contains language regarding property numbering which is more restrictive regarding number size and stroke than Section 160-3(A) of the Code of the Village of Rye Brook; and WHEREAS, a proposed local law has been prepared to make the Section 160-3(A) of the Code of the Village of Rye Brook consistent with the IMPC regarding the size and display of property numbers; and WHEREAS, if approved, this local law would not require the replacement of property numbers currently being displayed on existing properties until such time that the display is being replaced or modified. NOW THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook shall hold a public hearing on this proposed local law regarding the size and display of property numbers on June 13, 2017 at 7:30 P.M., Village Hall, 938 King Street, Rye Brook,NY. Page 8 of 10 Board of Trustees May 9, 2017 We are doing this because state law is not consistent with our Village Code and the Village wants the laws to match. We cannot supercede the state law and we do see value in keeping this in our code. Residents can come and here what is involved- important meeting - trying to get info out to residents and surrounding communities Blood Drive - June 7th from 2-7pm at the Posillipo Center in honor of Carmella Swick and will provide information on brain cancer awareness.
