Village of Rye Brook.

Mr. Bradbury, with the assistance of Pasquale Colantouno, presented his
2017-2018 Budget with a slide presentation.
After completion the Board thanked Mr. Bradbury for his hard work stating it
was one of the best presentations ever. Mayor Rosenberg is very impressed
with the fiscal transparency program and hopes residents take advantage of it.
He is also grateful that we did not have to break the tax cap - we are using a
lot more money to stay within the tax cap -we have done our part but the
State has failed to do its part again not coming thru with the rebate checks.
Trustee Heiser thanked Mr. Bradbury and all the Department Heads who
came up with a very tight budget for their departments.
Mayor Rosenberg spoke about the budget presentations and how they go
threw the budge for what is recommended and also what the department
heads request.
Trustee Klein also thanked everyone who worked so hard to put a great
budget together and we don't have to vote for over riding the tax cap -
thankful that we don't even have to consider doing it.
Mayor Rosenberg also acknowledged Ms. Diane DiSanto on her retirement
and thanked her as well for all her years of hard work and dedication.
Trustee Epstein also thanked everyone for their hard work on the budget- we
derive a lot of services in the Village and encouraged people to come out to
the meetings and the budget work sessions. Trustee Heiser agreed- this is the
time for residents to come out and ask questions.

RESOLUTION
CONSIDERING A PROPOSED LOCAL LAW AUTHORIZING A
PROPERTY TAX LEVY IN EXCESS OF THE LIMIT ESTABLISHED
IN GENERAL MUNICIPAL LAW SECTION 3-C FOR THE FISCAL
YEAR BEGINNING JUNE 19 2017
WHEREAS, a proposed local law authorizing a property tax levy in excess
of the limit established in General Municipal Law Section 3-c for the fiscal
year commencing June 1, 2017 was introduced at the regular meeting of the
Village Board held on March 28, 2017 at which time a public hearing was set
for April 12, 2017; and
WHEREAS, the notice of public hearing was advertised in the March 31,
2017 edition of the Westmore News as the Official Newspaper of the Village
of Rye Brook; and
WHEREAS, the public hearing was held on April 12, 2017 at which time all
person interested in speaking on this matter were given an opportunity to be
heard, after which the public hearing was closed.
NOW THEREFORE BE IT RESOLVED, that after careful consideration
of the proposed local law, comments received at the public hearing on said
proposed local law, and the status of the Tentative Budget, the Board of
Trustees of the Village of Rye Brook hereby DOES NOT enact the proposed
local law authorizing a property tax levy in excess of the limit established in
General Municipal Law Section 3-c for the fiscal year commencing June 1,
2017.

6 RESOLUTIONS:
a) Considering the authorization of funds for the 2017 Memorial Day and
Veterans Day Ceremonies to be paid to the American Legion.
With the consent of the Board, this application was also moved up on the
agenda.
Mr. Bradbury read the resolution:
RESOLUTION
CONSIDERING THE AUTHORIZATION OF FUNDS FOR THE 2017
MEMORIAL DAY AND VETERNANS DAY CEREMONIES TO BE
PAID TO THE AMERICAN LEGION
WHEREAS, the American Legion, Port Chester Post 93, will host the 2017
Memorial Day Ceremony on May 29, 2017; and
WHEREAS, the Village of Rye Brook Village Board would like to assist the
American Legion with this event.
NOW, THEREFORE BE IT RESOLVED, that the Village of Rye Brook
will pay one thousand five hundred dollars ($1,500.00) to the American
Legion for its 2017 Memorial Day Ceremony and for any potential 2017
Veterans Day Ceremony.

b) Considering the renewal of a special permit for a one car garage for a
property at 1100 King Street.
With the consent of the Board, this application was moved up on the agenda
and was heard first.
Mr. Bradbury read the resolution:
RESOLUTION
APPROVING RENEWAL OF A SPECIAL PERMIT FOR A ONE
CAR GARAGE AT 1100 KING STREET (RECKSON
EXECUTIVE PARK)
VILLAGE OF RYE BROOK BOARD OF TRUSTEES
WHEREAS, on April 24, 2012 the Village of Rye Brook Board of
Trustees adopted a resolution approving applications by Reckson
Operating Partnership, LP, property owner, for a special permit and site
plan amendment for the construction of a one car garage on the north
side of an existing parking lot at Reckson Executive Park on property
located at 1100 King Street, designated as Section 124.8 1, Block 1, Lot
1 on the Town of Rye Tax Map and located in the OB-1 Zoning District
and Scenic Roads Overlay District; and
WHEREAS, pursuant to the terms and conditions of the Resolution
the Special Permit was valid for a period of 5 years following the date
of the Resolution and may be renewed by the Board of Trustees upon
written request, provided the applicable special permit standard are
satisfied; and
WHEREAS, the Special Permit is scheduled to expire on April 24,
2017; and
WHEREAS, on March 30, 2017 the Village received a letter dated
March 29, 2017 from Anthony B. Gioffre, Esq., Cuddy & Feder LLP,
submitted on behalf of Reckson Operating Partnership, L.P., requesting
renewal of the previously issued Special Permit; and

WHEREAS, the proposed action is a Type II action pursuant to the
New York State Environmental Quality Review Act (SEQRA) and
therefore no SEQRA review is required; and
WHEREAS, the Village Code does not require a public hearing for a
request to renew a Special Permit; and
WHEREAS, the Board of Trustees has considered the special permit
standards set forth at Village Code §§ 250-6(H)(1)(c)(1) and 250-6(H)
(1)(c)(4) to determine whether the existing use continues to satisfy the
special permit standards; and
WHEREAS, the Board of Trustees is familiar with the site and all
aspects of the application.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Trustees hereby finds that the existing one-car garage at 1100 King
Street continues to satisfy the special permit standards referenced
herein and grants the requested renewal of the Special Permit for the
existing use for a term of five (5) years commencing as of the date of
this Resolution, subject to the following conditions:
1. A fire suppression system in conformance with Chapter 212 of
the Village Code shall continue to be maintained for the one-car
garage.
2. The Special Permit may be further renewed at the expiration of
this 5-year renewal term upon written request provided the
applicable special permit standards are satisfied.
BE IT FURTHER RESOLVED, that no permits shall be
issued until the Applicant has paid to the Village all applicable fees
and professional review fees incurred in connection with review of
this Application.
Mr.Gioffre addressed the Board and thanked them for advancing his
application and asked the Board to consider making this permit indefinite
instead of every 5 years.
Mr. Bradbury responded that it would ultimately be up to the Board but
having renewal every 5 years allows the Village to continue to monitor the

site.
Mr. Gioffre explained how this garage came to be was to draw a certain
tenant into a lease because finding tenants at that time was difficult, they
agreed to a private garage to close the deal. He did remind the Board that
any modifications that might be made to the garage would have to go
threw the proper channels in the Village before proceeding.
Mr. Bradbury responded that we would have to research the code for
special permits to see if it is ok or if there are limitations. He also
reminded the Board that with having to renew the permit, if the tenant
were to leave, the Board can revoke the permit.
Mayor Rosenberg explained to Mr. Gioffre that we could either renew for
5 years tonight or table this tonight and do the research. Mr. Gioffre
agreed to the 5 year renewal.

c) Considering a bond for the replacement of the King Street turf field.
Mr. Bradbury read the resolution:
RESOLUTION
AUTHORIZING THE ISSUANCE OF $265,000 BONDS OF THE
VILLAGE OF RYE BROOK, WESTCHESTER COUNTY,NEW
YORK, TO PAY PART OF THE $828,000 ESTIMATED MAXIMUM
COST OF THE REPLACEMENT OF A TURF FIELD INCLUDING
GOALPOSTS AND RELATED IMPROVEMENTS AT 830 KING
STREET, IN AND FOR SAID VILLAGE.
WHEREAS, all conditions precedent to the financing of the capital purposes
hereinafter described, including compliance with the provisions of the State
Environmental Quality Review Act to the extent required, have been
performed; and
WHEREAS, it is now desired to authorize the financing of such purposes;

NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the
Village of Rye Brook, Westchester County, New York, as follows:
Section 1. For paying part of the cost of the replacement of a turf field
including goalposts and related improvements at 830 King Street, including
incidental expenses in connection therewith, a specific object or purpose,
there are hereby authorized to be issued $265,000 bonds of said Village
pursuant to the Local Finance Law. None of the objects or purposes are
assessable improvements.
Section 2. It is hereby determined that the estimated maximum cost of the
aforesaid specific object or purpose is $828,000, and that the plan for the
financing thereof shall be by the issuance of the $265,000 bonds authorized
pursuant to this bond resolution, together with $323,000 received from Sun
Homes as a contribution toward the cost of the aforesaid purposes and
$240,000 to be appropriated from a reserve fund created to pay part of the
cost of the aforesaid purposes.
Section 3. It is hereby determined that the period of probable usefulness of
the aforesaid specific object or purpose is fifteen years, pursuant to
subdivision nineteen of paragraph a of Section 11.00 of the Local Finance
Law. It is hereby further determined, however, that the maximum maturity of
the bonds authorized will not exceed five years.
Section 4. Subject to the provisions of the Local Finance Law, the power to
authorize the issuance of and to sell bond anticipation notes in anticipation of
the issuance and sale of the bonds herein authorized, including renewals of
such notes, is hereby delegated to the Village Treasurer, the chief fiscal
officer. Such notes shall be of such terms, form and contents, and shall be
sold in such manner, as may be prescribed by said Village Treasurer,
consistent with the provisions of the Local Finance Law.
Section 5. The faith and credit of said Village of Rye Brook, Westchester
County, New York, are hereby irrevocably pledged to the payment of the
principal of and interest on such bonds as the same respectively become due
and payable. An annual appropriation shall be made in each year sufficient to
pay the principal of and interest on such bonds becoming due and payable in
such year. There shall annually be levied on all the taxable real property of
said Village a tax sufficient to pay the principal of and interest on such
obligations as the same become due and payable.
Section 6. Such bonds shall be in fully registered form and shall be signed in
the name of the Village of Rye Brook, Westchester County,New York, by the
manual or facsimile signature of the Village Treasurer and a facsimile of its
corporate seal shall be imprinted or impressed thereon and may be attested by
the manual or facsimile signature of the Village Clerk.
Section 7. The powers and duties of advertising such bonds for sale,
conducting the sale and awarding the bonds, are hereby delegated to the
Village Treasurer, who shall advertise such bonds for sale, conduct the sale,
and award the bonds in such manner as he shall deem best for the interests of
the Village; provided, however, that in the exercise of these delegated
powers, the Village Treasurer shall comply fully with the provisions of the

Local Finance Law and any order or rule of the State Comptroller applicable
to the sale of municipal bonds. The receipt of the Village Treasurer shall be a
full acquittance to the purchaser of such bonds, who shall not be obliged to
see to the application of the purchase money.
Section 8. All other matters, except as provided herein relating to such bonds,
including determining whether to issue such bonds having substantially level
or declining annual debt service and all matters related thereto, prescribing
whether manual or facsimile signatures shall appear on said bonds,
prescribing the method for the recording of ownership of said bonds,
appointing the fiscal agent or agents for said bonds,providing for the printing
and delivery of said bonds (and if said bonds are to be executed in the name
of the Village by the facsimile signature of its Village Treasurer, providing
for the manual countersignature of a fiscal agent or of a designated official of
the Village), the date, denominations, maturities and interest payment dates,
place or places of payment, and also including the consolidation with other
issues, shall be determined by the Village Treasurer. It is hereby determined
that it is to the financial advantage of the Village not to impose and collect
from registered owners of such bonds any charges for mailing, shipping and
insuring bonds transferred or exchanged by the fiscal agent, and, accordingly,
pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such
charges shall be so collected by the fiscal agent. Such bonds shall contain
substantially the recital of validity clause provided for in Section 52.00 of the
Local Finance Law and shall otherwise be in such form and contain such
recitals in addition to those required by Section 52.00 of the Local Finance
Law, as the Village Treasurer shall determine.
Section 9. This resolution shall constitute a statement of official intent for
purposes of Treasury Regulations Section 1.150 - 2. Other than as specified
in this resolution, no monies are, or are reasonably expected to be, reserved,
allocated on a long-term basis, or otherwise set aside with respect to the
permanent funding of the object or purpose described herein. The Village
Treasurer may advance funds for any purpose for which such bonds are
authorized,pursuant to Section 165.00 of the Local Finance Law.
Section 10. The validity of such bonds and bond anticipation notes may be
contested only if:
(1) Such obligations are authorized for an object or purpose for which said
Village is not authorized to expend money, or
(2) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with, and an
action, suit or proceeding contesting such validity is commenced within
twenty days after the date of such publication, or

substantially the form provided in Section 81.00 of the Local Finance Law.

d) Considering a bond for the purchase of a "Gator"utility vehicle.
Mr. Bradbury read the resolution:
RESOLUTION

VILLAGE OF RYE BROOK, WESTCHESTER COUNTY,NEW
YORK, TO PAY THE COST OF A "GATOR" UTILITY VEHICLE, IN
AND FOR SAID VILLAGE.
WHEREAS, all conditions precedent to the financing of the capital purposes
hereinafter described, including compliance with the provisions of the State
Environmental Quality Review Act to the extent required, have been
performed; and
WHEREAS, it is now desired to authorize the financing of such purposes;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the
Village of Rye Brook, Westchester County, New York, as follows:
Section L For paying the cost of a "Gator" utility vehicle, for use for
maintenance purposes, including incidental expenses in connection
therewith, a specific object or purpose, there are hereby authorized to be
issued $15,000 bonds of said Village pursuant to the Local Finance Law.
None of the objects or purposes are assessable improvements.

WHEREAS, all conditions precedent to the financing of the capital purposes
hereinafter described, including compliance with the provisions of the State
Environmental Quality Review Act to the extent required, have been
performed; and
WHEREAS, it is now desired to authorize the financing of such purposes;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the
Village of Rye Brook, Westchester County, New York, as follows:
Section 1. For paying the cost of the purchase of a front end loader truck,
including incidental expenses in connection therewith, a specific object or
purpose, there are hereby authorized to be issued $220,000 bonds of said

Section 3. It is hereby determined that the period of probable usefulness of
the aforesaid specific object or purpose is fifteen years, pursuant to
subdivision twenty-eight of paragraph a of Section 11.00 of the Local
Finance Law. It is hereby further determined, however, that the maximum
maturity of the bonds shall not exceed five years.

Section 4. Subject to the provisions of the Local Finance Law, the power to
authorize the issuance of and to sell bond anticipation notes in anticipation of
the issuance and sale of the bonds herein authorized, including renewals of
such notes, is hereby delegated to the Village Treasurer, the chief fiscal
officer. Such notes shall be of such terms, form and contents, and shall be
sold in such manner, as may be prescribed by said Village Treasurer,
consistent with the provisions of the Local Finance Law.
Section 5. The faith and credit of said Village of Rye Brook, Westchester
County, New York, are hereby irrevocably pledged to the payment of the
principal of and interest on such bonds as the same respectively become due
and payable. An annual appropriation shall be made in each year sufficient to
pay the principal of and interest on such bonds becoming due and payable in
such year. There shall annually be levied on all the taxable real property of
said Village a tax sufficient to pay the principal of and interest on such
obligations as the same become due and payable.
Section 6. Such bonds shall be in fully registered form and shall be signed in
the name of the Village of Rye Brook, Westchester County,New York, by the
manual or facsimile signature of the Village Treasurer and a facsimile of its
corporate seal shall be imprinted or impressed thereon and may be attested by
the manual or facsimile signature of the Village Clerk.
Section 7. The powers and duties of advertising such bonds for sale,
conducting the sale and awarding the bonds, are hereby delegated to the
Village Treasurer, who shall advertise such bonds for sale, conduct the sale,
and award the bonds in such manner as he shall deem best for the interests of
the Village; provided, however, that in the exercise of these delegated
powers, the Village Treasurer shall comply fully with the provisions of the
Local Finance Law and
any order or rule of the State Comptroller applicable to the sale of municipal
bonds. The receipt of the Village Treasurer shall be a full acquittance to the
purchaser of such bonds, who shall not be obliged to see to the application of
the purchase money.
Section 8. All other matters, except as provided herein relating to such bonds,
including determining whether to issue such bonds having substantially level
or declining annual debt service and all matters related thereto, prescribing
whether manual or facsimile signatures shall appear on said bonds,
prescribing the method for the recording of ownership of said bonds,
appointing the fiscal agent or agents for said bonds,providing for the printing
and delivery of said bonds (and if said bonds are to be executed in the name
of the Village by the facsimile signature of its Village Treasurer, providing
for the manual countersignature of a fiscal agent or of a designated official of
the Village), the date, denominations, maturities and interest payment dates,
place or places of payment, and also including the consolidation with other
issues, shall be determined by the Village Treasurer. It is hereby determined

that it is to the financial advantage of the Village not to impose and collect
from registered owners of such bonds any charges for mailing, shipping and
insuring bonds transferred or exchanged by the fiscal agent, and, accordingly,
pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such
charges shall be so collected by the fiscal agent. Such bonds shall contain
substantially the recital of validity clause provided for in Section 52.00 of the
Local Finance Law and shall otherwise be in such form and contain such
recitals in addition to those required by Section 52.00 of the Local Finance
Law, as the Village Treasurer shall determine.
Section 9. This resolution shall constitute a statement of official intent for
purposes of Treasury Regulations Section 1.150 - 2. Other than as specified
in this resolution, no monies are, or are reasonably expected to be, reserved,
allocated on a long-term basis, or otherwise set aside with respect to the
permanent funding of the object or purpose described herein. The Village
Treasurer may advance funds for any purpose for which such bonds are
authorized, pursuant to Section 165.00 of the Local Finance Law.
Section 10. The validity of such bonds and bond anticipation notes may be
contested only if:
(1) Such obligations are authorized for an object or purpose for which said
Village is not authorized to expend money, or
(2) The provisions of law which should be complied with at the date of
publication of this resolution are not substantially complied with,and an
action, suit or proceeding contesting such validity is commenced within
twenty days after the date of such publication, or
(3) Such obligations are authorized in violation of the provisions of the
Constitution.
Section 11. This resolution, which takes effect immediately, shall be
published in summary in The Journal News, a newspaper having general
circulation in said Village, together with a notice of the Village Clerk in
substantially the form provided in Section 81.00 of the Local Finance Law.

Mayor Rosenberg explained that this is a complicated bid as there are several
alternates included. The turf field is at the end of its life basically and a
number f the alternates are for the cushion pad and replacing the goal posts.
When asked why the goal posts had to be replaced, Mr. Bertolacci explained
that the existing goal posts are always tilting - they refuse to stay up straight.
Mayor Rosenberg is very happy with the bids as the are much lower than
expected.
Trustee Epstein thanked Mr. Bertolacci and Mr. Bradbury for their work on
this and explained that the padding underneath is very important because it
will assist in reducing injuries to bones and concussions.

WHEREAS,the Village must publish legal notices in any newspaper designated
as the official newspaper for the municipality; and
WHEREAS, the Westmore News is a newspaper circulated and available to its
residents in the Village of Rye Brook; and
WHEREAS, the Village Clerk is encouraged to publish notices in multiple
newspapers covering the village
NOW THEREFORE BE IT RESOLVED, that the Westmore News is hereby
designated as the official Newspaper of the Village of Rye Brook for the ensuing
official year.

FRIENDS OF RYE BROOK, INC.
RESOLVED, that it is hereby disclosed by members of the Board of Trustees
that they are directors of a not-for-profit corporation, the Friends of Rye Brook,
Inc., created to assist in obtaining donations from prospective grantors in support
of qualifying activities of the Village.

RE-ADOPTION OF RULES OF PROCEDURE
OF BOARD OF TRUSTEES
RESOLVED, that the Rules of Procedure of the Board of Trustees as amended
on April 11, 2006 are hereby re-adopted and promulgated for the Village official
year, commencing the first Monday of April 2016.

Code regarding residential lot area coverage to the Planning Board.

CONSIDERING A LOCAL LAW AMENDING CHAPTER 250 OF
THE CODE OF THE VILLAGE OF RYE BROOK
WHEREAS, a proposed local law was introduced to amend Chapter 250 of
the Code of the Village of Rye Brook to address an incorrect reference to a
section of the Village Code regarding the OB-2 Office Building District and
clarify existing provisions regarding residential lot area coverage; and
WHEREAS, the Board of Trustees, pursuant to the State Environmental
Quality Review Act (SEQRA) determines the proposed action to be Type 11
Action pursuant to SEQRA, therefore no further environmental review is
required.
NOW, THEREFORE, BE IT RESOLVED,that the Board of Trustees
hereby refers the above-referenced local law to the Planning Board for
Report and Recommendation.
BE IT FURTHER RESOLVED, that the Board of Trustees hereby refers
the above-referenced local law to the Westchester County Planning
Department for comment pursuant to the General Municipal Law and
Westchester County Administrative Code.

7 ADMINISTRATOR'S REPORT:
Village Hall will be closed on Friday in observance of Good Friday.
Water restrictions are still in effect although they have been slightly relaxed.
The New York reservoirs are up but the Connecticut reservoirs are still short.
Purchase College is proposing a major project near Anderson Hill Road and
some of our residential properties. We need to make sure the development
wont have a negative impact on our residents - comments will be accepted
until May 19th- we will focus on water supply - storm water and traffic at
various intersections.
Mike Nowak is preparing the paving bid which will go out next week and will
include Hawthorne Avenue- only issues is if we are including double yellow
lines and white lines on side of street- the Board will need to decide which
direction to go
Westchester County Airport is looking to privatize and have put out an RFP.
Important that the ommunity be aware
The Sustainability Committee is hold an Earth Day contest - the winners will
receive Village tote bags
Little league opening day and parade is Saturday, April 22nd at 12:30 at Ridge
Street School.
Arbor day is April 8th this year.

Prior to adjournment, Mr. David Grippo ofJaqueline.Lane addressed the Board for over 40 minutes
with multiple concerns ranging from oil spills.....drainage issues ...his neighbor using illegal sump

pumps and the noise is so loud he hasn't slept in three years and�is his
s rattle constantly and he
cant get help from anyone. He helps the Village on a regular basis findng oil spills—helping his
neighbors—raking out the leaves from the circle—helping people shovel and he just wants the
Village to help him in return so that he can live in his home and have some peace
