Chapter 240, Section 11, Subsections B and C of the Code of the Village of Rye Brook is hereby amended as follows: §240-11 Main arteries;yield intersections; stop intersections. Severability. If any clause, sentence, paragraph, section, article or part of this Local Law shall be adjudicated in any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, section, article or part thereof directly involved in the controversy in which such judgment shall have been rendered, and such invalidity shall not be deemed to affect the remaining portions thereof. The Commission did receive a complaint from a resident of Charles Lane regarding a hazardous condition that exists on the street.It was requested that the current Yield sign be changed to a Stop Sign making the intersection a three way stop. The Traffic Commission does recommend to the Rye Brook Board of Trustees that this change be made.I do not know if the current Post is in the correct spot for a Stop Sign,The Rye Brook Highway Department may need to relocate the sign Post. It was requested that the current yield sign at the intersection be changed to a stop sign. At the Village Board meeting on January 24, 2017, a public hearing was set for Tuesday, February 28, 2017 at 7:30 PM at Village Hall. Christopher J.Bradbury Village of Rye Brook,New York Publication Date:Friday, January 27, 2017 Page 12 of 35 February 28,2017 RESOLUTION CONSIDERING A PROPOSED LOCAL LAW AMENDING CHAPTER 240 OF THE VILLAGE CODE FOR A STOP SIGN AT MARK DRIVE AND PINE RIDGE ROAD WHEREAS,a traffic condition at the intersection of Mark Drive and Pine Ridge road was reported from a resident at the Traffic Commission Meeting held on October 24,2016; and WHEREAS,on January 3,2017 a recommendation was made by the Traffic Commission to change the yield sign at the intersection to a stop sign; and WHEREAS,on January 24,2017 a proposed local law was introduced to amend Chapter 240 of the Village Code of the Village of Rye Brook to implement the proposed recommendation; and WHEREAS,on February 28,2017,the Board of Trustees held a duly noticed public hearing at Village Hall to consider the proposed local law, at which time all persons interested were given an opportunity to be heard. THEREFORE BE IT RESOLVED,that the Board of Trustees of the Village of Rye Brook hereby approves the above-mentioned local law to amend Chapter 240 of the Village Code regarding a stop sign at Mark Drive and Pine Ridge Road. Page 13 of 35 RESOLUTION CONSIDERING THE ADOPTION OF LOCAL ADJUSTMENTS FOR HOMESTEAD AND NON-HOMESTEAD BASE PROPORTIONS WHEREAS, on January 25, 2005 the Board of Trustees adopted Local Law #2-2005 relating to the adoption of the provisions of Section 1903 of the Real Property Tax Law regarding Homestead Base Proportions;and WHEREAS, the Town of Rye Assessor has prepared Homestead and Non-Homestead base proportions for the Village of Rye Brook s review;and WHEREAS, on February 21, 2017 the Town Board of the Town of Rye adopted a resolution that (a) establishes two separate property tax rates for the Village of Rye Brook pursuant to the provisions of Section 1903 of the RPTL(I) the Homestead Base Proportion at a rate equal to 72.166008 and (II) the Non-Homestead Base Proportion at a rate equal to 27.833992 and (b) authorized the Town Assessor to file a Statement of Locally Determined Homestead Base Proportions Pursuant to Section 1903 of the Real Property Tax Law (RPTL) (commonly referred to as the Homestead Tax Option ) based on the 2016 Assessment Roll (completed,verified and filed in 2016) for the 2017 Village budget and tax rates;and WHEREAS, the Board of Trustees of the Village of Rye Brook also wishes to concur and adopt the local adjustments to these homestead base proportions that will be used to establish a Homestead tax rate and a Non-Homestead tax rate for the 2017-2018 Village Budget and tax rates. NOW THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Rye Brook hereby concurs with the Town of Rye and adopts for the FY 2017-18 Village tax purposes a Homestead Base Proportion at a rate equal to 72.166008, and Non-Homestead Base Proportion at a rate equal to 27.833992;and BE IT FURTHER RESOLVED, that the Mayor and Village Administrator are authorized to sign all necessary documents to implement the purposes of this resolution;and BE IT FURTHER RESOLVED, that the Town Assessor and Tax Collector are authorized and directed to make any filings on behalf of Rye Brook, and to take any additional actions necessary to implement the purposes of this resolution. Page 14 of 35 RESOLUTION Resolution of the Town Board of the Town of Rye Establishing a Homestead Base Proportion for the Village of Rye Brook and to Authorize the Town Assessor to File a Statement of Locally Determined Homestead Base Proportions Pursuant to and in Accordance with the Provisions of Section 1903 of the Real Property Tax Law Commonly Referred to as the "Homestead Tax Option" based on the 2016 Assessment Roll (completed, verified and filed in 2016)for the 2017 Village budget and tax rates. On motion of Councilperson Nardi, seconded by Councilperson Villanova, the following Resolution was adopted: WHEREAS, in 1981, the State of New York enacted Section 1903 of the Real Property Tax Law(RPTL) known as the "Homestead Tax Option"; and WHEREAS, the Homestead Tax Option was enacted to prevent a disproportionate shift of property tax burden to residential property owners following a revaluation of real property; and WHEREAS, the Town Board adopted a Local Law on March 23, 2004 entitled "A Local Law Adopting the Provisions of Section 1903 of the Real Property Tax Law" commonly referred to as the"Homestead Tax Option" (the"Local Law");and WHEREAS, pursuant to the Local Law,the Town Board desires to establish two separate property tax rates for the Village of Rye Brook; a rate for residential property owners equal to a rate of 72.166008(the"Homestead Base Proportion") and a rate for all other property owners equal to a rate of 27.833992 (the "Non-Homestead Base Proportion") and to authorize the Town Assessor to file a Statement of Locally Determined Homestead Base Proportions Pursuant to Section 1903 of the RPTL based on the 2016 Assessment Roll (completed,verified and filed in 2016)for the 2017 Village budget and tax rates;and NOW,THEREFORE, BE IT RESOLVED BY THE TOWN BOARD AS FOLLOWS: 1. The Pee Wee Tennis instruction is for 4 and 5 year olds. The participants receive a 45 minute lesson. The Youth Tennis Instruction is for Kindergarten through High School. The participants receive a one hour lesson. The Adult program is for adults and operates during the daytime hours. The participants receive a one hour lesson. At the current rate,a minimum of four(4)participants is needed to provide the class and justify the cost of a Future Stars instructor to provide the lessons. We have been having some difficulty getting this minimum number of registrants in past seasons. As a result, the adult classes(and some others)have been cancelled due to low enrollment. Future Stars cannot pay their instructor and give the Village 20%if they don't have either enough attendees in the program or a higher fee. By increasing the fee,we would be able to reduce the minimum per class to two(2)participants,which will enable those still interested to attend these classes. I note that although the tennis fees on the Fee Schedule are broken down to a fee per class,the fee is paid for the entire season based on the amount of classes to be held each season. The Spring is dependent on when holidays such as Easter and Passover occur on the calendar. The sewer system evaluation study was just completed and sent to the County.It is a lot of work and a lot of money making sure infrastructure is maintained-about$108,000 authorized to have our Engineering Consultant go out to bid.
