A meeting of the Zoning Board of Appeals of the Town of Rye was called to order by Chairman Quigel at 8 :25 P.11. , Tuesday, As February 3rd, 1941. Present:- Harvey Q,uige l ) Members of Irving E. Ferris,Jr ) The Board Harold J . dilliams ) John L. Coward Town Attorney James F. lteilsen Building Inspector Chairman Quigel read the Public Notice dated January 27th which announced the purpose of thie evenings public meeting to consider the appeal of PRO-RIE ]SOME S, INC . from an order of James R. Neilsen, Building Inspector of the Town of Rye, denying* a building permit to the said corporation for the eraction of a house on premises situated on the southerly side of Irenhyl Avenue and designated on the assessment map of the town of Faye as Section 1. Blac''c 15, Lot 1C, on the grounds that the building as shown on the plot plan submitted with the application for a permit, violates the provisions of Sections 12 and 13 of the Zoning Ordinances of the Town of Rye, a" Affidavit of publication of public notice pretaininx to this meeting was presented by Mr. Coward from the Port Chester "Daily Item". This was ordered received and placed on file. Building Inspector James ii. Neilsen advised the Board regarding the request from FRO-HIE DOMES, Inc. and exhibited a tracing of the plot plan which was presented by the said corp- oration. Ir. Neilsen futther advised the Board that he had rejected this apllication due to the same oeing a violation of the Town Zoning Ordinance. Chairman. (�uigel asked who wished to be heard in connect- ion with this appeal. kessere Samuel Provino and Henry G. Riekere appeared before the Hoard and presented their request for an appeal from the Ordinance . No others appeared before the joard . it was. -On Motion made by 1,ir. Ferris and seconded by 11r. Williams RESOLVES, that the appeal of 1c0-REE H01tMS, INC . from an order of James h. Neilsen, 3uilding Inspector of the gown of Rye, denying a building permit, be granted subjeet to their reducing the front yard depth from the thirty ( 301 ) foot requirements to twenty ( 2010 feet ; the side yard width to be increased from the eight (81 ) foot as required to sixteen ( 1.61 ) feet at the closest corner of the building to the westerly side lot line; and the depth of the rear ,yard to be reduced from the thirty (301 ) feet required to a minimum of twenty (201 ) feet to the corner of the building nearest to the rear or southerly lot line; and that the building Inspector of the Town, of hye be authorized to issue the bui.ldinw permit accordingly, provided that all other requirements are complied with.
